  • Samkvæmt Barnasáttmála Sameinuðu þjóðanna og fleiri alþjóðasamningum hefur Ísland skuldbundið sig að þjóðarétti til þess að gæta réttinda barna í hvívetna. Í þessu riti verður fjallað um sérstök réttindi barna sem getið er í mörgum samningum og reglum Sameinuðu þjóðanna, en það eru réttindi barna sem svipt eru sjálfræði sínu vegna brota á refsilögum. Samkvæmt a.m.k. tveimur alþjóðasamningum, Barnasáttmálanum og alþjóðasamningi um borgaraleg og stjórnmálaleg réttindi, skal halda börnum sem afplána óskilorðsbundnar refsingar aðskildum frá fullorðnum föngum. Lagaumhverfið á Íslandi tryggir ekki að svo sé í öllum tilvikum og hafa verið gerðar athugasemdir við það af samninganefndum Sameinuðu þjóðanna. Vinna hefur verið lögð í af hálfu Íslands að finna lausnir á fangelsismálum á Íslandi, þ.á.m. afplánunarmálum sakhæfra barna en sú vinna hefur ekki enn borið árangur og standa ýmis ljón í veginum. Einnig hefur verið lögð áhersla á að lögfesta Barnasáttmála Sameinuðu þjóðanna, en vegna afplánunarmála barna er það ekki mögulegt að svo stöddu. Að teknu tilliti til hinna ýmsu þátta málsins er niðurstaða höfundar sú að Ísland ætti að leita annarra leiða þegar kemur að óskilorðsbundnum refsingum sakhæfra barna en að einblína á húsnæðis- og vistunarmál og leitast við að uppfylla og lögfesta Barnasáttmálann með öðrum áherslum en hefur verið gert.

    According to the Convention on the Rights of the Child and other international agreements, Iceland has committed itself to protect the rights of children in all respects. This thesis addresses the specific rights of children mentionedin many contracts and regulations of the United Nations and focuses on the rights of children who are deprived of their autonomy because of violations of criminal law. According to at least two international agreements, the Convention on the Rights of the Child and the ICCPR, children who are to serve a sentence, must be kept away from adult inmates. The legal environment in Iceland does not allow for such measures in all cases, which has been commented on by the negotiating committee of the United Nations. Iceland has put substantial work into finding solutions to the matter of the correctional facilities in Iceland, including the matter of children who have to serve a sentence. That work has yet to become effective, as many obstacles are in the way. Also, emphasize has been put on legalizing the Convention on the Rights of the Child, but due to the sentencing of children, it has not been possible as of yet. Taking into account the various aspects of the matter, it is this author’s conclusion that Iceland should seek other ways when it comes to punishment of children than to focus on housing and unconditional sentences, as well as seeking to fulfill and legalize the Convention on the Rights of the Child with other priorities than has been done.
