  • Meginviðfangsefni ritgerðarinnar er saknæmi í fíkniefnalöggjöf og hvaða áhrif það hefur við sönnun í málum vegna brota á lögum um ávana- og fíkniefni nr. 65/1974. Að auki er kynnt þróun fíkniefnalöggjafarinnar á Íslandi og á alþjóðavísu, gildandi löggjöf og samspil laga nr. 65/1974 um ávana- og fíkniefni og almennra hegningarlaga nr. 19/1940 og þá sérstaklega ákvæðis 173. gr. a.
    Sýndar eru tölulegar upplýsingar um fjölda fíkniefnabrota á Íslandi árin 2007-2013 og að mál sem koma til kasta lögreglu vegna brota gegn ávana- og fíkniefnalöggjöf varða langflest vörslur fíkniefna. Fjallað er um vörslur almennt og kynnt hvernig málum er lokið með sektargerð, en flestum málum er varða vörslu fíkniefna er lokið á þann hátt sem lögreglustjórar afgreiða hver í sínu umdæmi.
    Skoðað er hvernig saknæmi birtist í bæði danskri og norskri fíkniefnalöggjöf og það borið saman við þá íslensku. Frávik frá saknæmisreglunni eru kynnt og þá er leitast við að svara spurningunni um hvort dómstólar á Íslandi hafi tilhneigingu til að beita hlutlægri refsiábyrgð í málum er varða vörslur fíkniefna gegn eindreginni neitun sakbornings. Það er m.a. gert með því að skoða dóma Hæstaréttar Íslands á tímabilinu 2007-2013. Þegar litið er til dómaframkvæmdar Hæstaréttar Íslands má sjá með nokkuð skýrum hætti að dómstólar beita ekki hlutlægri refsiábyrgð í fíkniefnamálum heldur fylgja reglum um saknæmi þegar tekin er ákvörðun um sekt eða sýknu.

    ABSTRACT
    The main topic of this thesis is the concept of culpability in drug legislation and the impact it has on sentencing for violations of the Narcotic Drugs Act no. 65/1974. In addition the development of drug legislation in Iceland and world wide is discussed, including the current legislation and how Act. 65/1974 of the Narcotic Drug legislation interacts with the Criminal Code no. 19/1940 and in particular the provision of Article 173.a.
    Statistics on the number of drug offenses in Iceland for 2007-2013 are presented which show that in criminal cases referred to the police for offenses against narcotic drugs legislation, the vast majority are concerned with the possession of narcotics. The thesis discusses possession of drugs in general and of how cases are closed with a fine without judgment being passed a judicial settlement, which is how most possession infringements are dealt with by the police authorities in each respective district.
    The thesis examines how the concept of culpability appears in both Danish and Norwegian legislation and compares this to how it is dealt with in Icelandic law. Deviations from the principle of culpability are presented and answers sought to the question of whether courts in Iceland tend to apply objective criminal liability in cases of possession of drugs when the accused denies any responsibility. This includes an examination of the judgments passed by the Icelandic Supreme Court during the period 2007-2013. Given the case law of the Supreme Court it is clearly apparent that the courts do not apply an objective criminal liability for drug offenses but follow rules concerning conditions for criminal culpability when passing a sentence.
