    Technical Barriers to Trade (TBTs) exist in all sectors of the economy and play a vital role in shaping the flow of international trade. Most of the products we buy have been impacted by TBTs. The packaging of the food we consume, the labelling of the alcohol we drink and the technical specifications of the cars we drive are all, to a certain degree, affected by TBTs. The purpose of this thesis is to examine whether the international obligations imposed on EU and EEA Member States in the efforts to avoid unnecessary TBTs, intrude in any way upon the domestic regulatory autonomy of the EU and EEA Member States. To answer this question, an examination of the notification procedures established by the World Trade Organisation, the EU and the EEA, which require new technical regulations to be notified before they are adopted, and enforce relevant consequences in the case of a failure to notify, is provided. To this end, Chapter 2 provides the definition of TBTs. A review of the WTO and the TBT Agreement is found in Chapter 3. Chapter 4 contains an analysis of the EU approach to TBTs, which, inter alia, includes a review of the extensive TBT notification system that has been established under EU law. Chapter 5 provides an examination of EEA law, in order to assess if the TBT notification system and the approaches applied under EU law correspond to those under EEA law, or whether there are any fundamental differences between the two. The conclusion of the thesis is that Members States of the EU and EEA are required to fulfil various obligations to ensure the avoidance of unnecessary TBTs distorting the internal market. These obligations, which are outlined throughout the thesis, exert multiple limits upon domestic regulatory autonomy. Subsequently, Member States may not adopt unnecessary TBTs into their national legislation without being inviolation of their international obligations.

  • Tæknilegar viðskiptahindranir gegna stóru hlutverki í efnahagi heimsins og þá sérstaklega í alþjóðaviðskiptum. Tæknilegar viðskiptahindranir leynast víða og hafa áhrif á flestar reglur sem snúa að framleiðslu og sölu vöru. Sem dæmi hafa tæknilegar viðskiptahindranir áhrif á umbúðir, merkingar, þyngd, verð og orkunotkun vöru. Tilgangur þessarar ritgerðar er að rannsaka hvort þær alþjóðlegu skuldbindingar sem aðildarríki ESB og EES hafa undirgengist og snúa að takmörkun tæknilegra viðskiptahindranna skerði á einhvern hátt sjálfstjórnarétt aðildarríkjanna. Til þess að svara þessari spurningu verður fjallað um þær aðferðir sem stuðla að afnámi tæknilegra viðskiptahindranna. Þá verða gerð sérstök skil á þeim tilkynningarkerfum sem Alþjóðaviðskiptastofnunin, ESB og EES hafa komið á og byggja á því að jafnan skal senda drög að fyrirhuguðum tæknilegum reglugerðum til viðkomandi eftirlitsstofnunar. Ennfremur verður fjallað um hvaða afleiðingar það hefur fyrir aðildarríki ESB og EES að vanrækja tilkynningarskyldu. Af niðurstöðum má nefna að aðildarríki ESB og EES hafa undirgengist ýmsar skuldbindingar sem snúa að afnámi tæknilegra viðskiptahindranna. Þessar skyldur hafa meðal annars leitt til þess, að aðildarríkjum ESB og EES er óheimilt að setja á lög eða reglur sem fela í sér tæknilegar viðskiptahindranir nema að undangenginni tilkynningu til viðeigandi eftirlitsstofnunar.
