  • Umfjöllunarefni þessarar ritgerðar, sem er lokaverkefni til BA gráðu frá lagadeild Háskólans í Reykjavík, er árleg hlutfallstala kostnaðar. Markmið ritgerðarinnar er að upplýsa lesanda um hlutverk árlegrar hlutfallstölu kostnaðar í lánssamningum og hvaða upplýsingar eru innifaldar í hlutfallstölunni. Þá leitast höfundur við að upplýsa lesanda um hvaða reglur beri að miða við þegar upplýsingar í lánssamningi sem notaðar eru við útreikning hlutfallstölunnar eru óvissar og ómælanlegar. Íslenskar réttarreglur verða bornar saman við samsvarandi reglur í Evrópurétti og verður vikið að því hvort túlkun og beiting reglnanna hér á landi sé í samræmi við framkvæmd Evrópudómstólsins og EFTA-dómstólsins.
    Í öðrum kafla ritgerðarinnar er söguleg þróun regluverks um neytendalán skoðuð hérlendis og í Evrópusambandinu. Í þriðja og fjórða kafla ritgerðarinnar eru gildandi reglur skoðaðar áður en vikið verður að hlutfallstölunni sjálfri og þeim reglum sem um hana gilda í fimmta kafla. Í kafla sex verður einblínt á útreikning hlutfallstölunnar og vikið að þeim forsendum sem lánveitendur þurfa að gefa sér við útreikning hennar þegar þeir þættir sem forsendunum er ætlað að koma í stað eru óvissir og ómælanlegir. Höfundur mun leitast við að skýra forsendurnar með hliðsjón af leiðbeiningum Evrópusambandsins og gildandi reglum ásamt því að rannsaka hvort forsendur reglugerðarinnar veiti lausn við útreikning á hinum ýmsu lánakostum sem í boði eru.
    Af rannsóknarvinnu höfundar er dregin sú ályktun að birting hlutfallstölunnar er ein mikilvægasta skylda lánveitenda í lánssamningum um neytendalán, jafnvel þótt túlkun innlendra dómstóla sé ekki að öllu sambærileg túlkun Evrópudómstólsins. Forsendur reglugerðar 965/2013 þjóna mikilvægu hlutverki því í markmiði að lántaki geri sér grein fyrir þeim kostnaði sem hlýst af láni og að lokum er dregin sú ályktun af ákvæðum og markmiði laganna að lánveitendum beri að upplýsa um hærri hlutfallstölu, fremur en lægri, hafi þeir val um útreikning hennar.

    The topic of this thesis, which is for graduating with a B.A. degree from University of Reykjavík’s School of Law, is the Annual Percentage Rate of Charge (APR). Its objective is to inform the reader about the role of the APR in consumer credit agreements and what factors are included in the APR. The author will also try to inform the reader of how the assumptions mentioned in the Icelandic Consumer Credit Act no. 33/2013 and Regulation no. 965/2013, on the calculation of the APR, are used to inform consumers of the total cost of a credit when the elements used to calculate the APR are not known or cannot be ascertained at the time the APR is calculated. The Icelandic legal framework will be compared to that of the European Union (EU), with special focus on the interpretation of their case law.
    The second chapter of the thesis is about the history and development of the consumer credit law, both in Iceland and in the EU. In chapters three and four the current legal framework will be examined. Chapter five then covers the APR itself and relevant rules. Chapter six is about how the APR is calculated with special focus on the assumptions needed for its calculation when certain factors are unknown or cannot be ascertained, or may vary. The author will try to explain the assumptions by referring to the EU Commission’s guidelines on the application of the Consumer Credit Directive in relation to costs and the APR.
    The research reveals that the APR is one of the primary duties of a lender of consumer credit, even though the interpretation of the Icelandic courts is not fully consistent with that of EU’s Court of Justice. With reference to the objective and articles of the legal framework of consumer credit agreements, both the Icelandic Consumer Credit Act and the Consumer Credit directive 2008/48/EC, it is concluded that lenders shall inform consumers of a higher rather than lower APR if confronted with options on how to calculate it. It is also concluded that the assumptions that are found in regulation no. 965/2013 are important in terms of consumer protection.
