  • Markmið ritgerðarinnar er að leitast við að varpa ljósi á refsiábyrgð einstaklinga samkvæmt samkeppnislögum og þá hvernig kröfur bæði refsi- og sakamálaréttar falla að hinum ýmsu reglum samkeppnisréttar. Í öðrum kafla er farið yfir þær reglur og þau ákvæði sem eiga við þegar fengist er við refsiábyrgð einstaklinga í samkeppnismálum. Er þar helst að nefna 10. og 41. gr. a. samkeppnislaga. Í þriðja kafla er síðan farið yfir af hverju og að hvaða leyti refsiábyrgðar einstaklinga er þörf í samkeppnisrétti. Þá er í kafla fjögur farið yfir reglur sakamálaréttar og þær bornar saman við hinar ýmsu reglur samkeppnisréttar m.a. sönnunarreglur. Í kafla fimm er svo farið yfir flokkun samkeppnislagabrota, þ.e. eftir fullframningarstigi og eftir markmiði og afleiðingu. Næst, í kafla sex, er farið yfir skýrleika refsiheimilda og gert grein fyrir þeim kröfum sem gerðar eru til refsiheimilda og þær bornar saman við samkeppnislögin eins og þau eru í dag. Höfundur fór svo yfir upplýsingaskipti sem samkeppnislagabrot og fór fram athugun á því hvernig tekið yrði á upplýsingaskiptum á sviði sakamála. Að endingu var farið yfir dóm héraðsdóms Reykjaness í máli S-218/2014 ákæruvaldið gegn starfsmönnum Húsasmiðjunnar, BYKO og Úlfsins.
    Komist var að hinum ýmsu niðurstöðum í ritgerðinni en þar er helst að nefna niðurstöður um saknæmisstig samkeppnislaganna, skýrleika þeirra, sönnun og flokkun samkeppnislagabrota. Höfundur rökstyður það að saknæmisstig laganna nái aðeins til ásetnings eða vítaverðs gáleysis. Þá var komist að því að öfugri sönnunarbyrði yrði ekki beitt í refsimáli gegn einstaklingi. Höfundur rökstyður svo hvernig flokkun samkeppnislagabrota er háttað eftir fullframningarstigi og að skýrleika laganna sem refsiheimild sé ábótavant.

    The paper aims to shed light on individuals’ criminal liability according to the Competition Act and how the requirements of criminal law fit with various rules of competition law. The second section reviews those rules and the provisions that apply to individuals’ criminal liability in competition cases. Chief among these are Articles 10 and 41(a) of the Competition Act. The third section reviews why and to what extent individuals’ criminal liability is needed in competition law. The fourth section reviews the rules of criminal law and compares them with various rules of competition law, including the rules of evidence. The fifth section covers the classification of violations of the Competition Act; i.e., by degree of completion and by objective and consequences. The sixth section reviews the clarity of sanction provisions, sets forth the requirements made of sanction provisions, and compares them with the Competition Act as it is today. The author then reviewed exchange of information as a violation of competition law and conducted a survey of how exchange of information would be handled in accordance with criminal law. Finally, the author reviewed the judgment handed down by the District Court of Reykjanes in Case no. S-218/2014, the Prosecution vs. Employees of Húsasmiðjan, BYKO, and Úlfurinn.
    A number of conclusions are reached in the paper, particularly to include conclusions on criminality according to the Competition Act, the clarity of the Act, proof, and classification of violations of competition law. The author supports the argument that criminality according to the Act extends only to intent or gross negligence. It was also concluded that reversal of the burden of proof would not be applied in a criminal case against an individual. The author also explains the classification of violations of the Competition Act by degree of completion and supports the argument that the sanction provisions in the Act lack clarity.
