  • Markmið þessarar ritgerðar er að kanna vernd barna gegn ofbeldi í íslensku lagaumhverfi og varpa á það ljósi hvort alþjóðlegar skuldbindingar íslenska ríkisins á þessu sviði séu uppfylltar. Viðfangsefnið er mikilvægt, en fjöldi barna lifir dag hvern við ofbeldi eða í ótta við það og ljóst er að afleiðingarnar geta verið alvarlegar. Í ritgerðinni er ofbeldi af hendi foreldra eða umönnunaraðila gefin sérstakur gaumur, enda ekki síst í þeim tilvikum sem flókið er fyrir yfirvöld að bregðast við.
    Í upphafi ritgerðarinnar er fjallað um mismunandi birtingarform ofbeldis og afleiðingar þess, þar sem varpað er ljósi á mikilvægi barnaverndar. Þá er litið til alþjóðlegra skuldbindinga íslenska ríkisins er snúa að réttindum barna og vernd þeirra gegn ofbeldi. Sérstaklega eru teknir til umfjöllunar barnasáttmáli Sameinuðu þjóðanna og Mannréttindasáttmáli Evrópu, enda eru þessir sáttmálar veigamestir í þessu samhengi. Fjallað er um vernd barna gegn ofbeldi sem tilgreint er í sáttmálunum og þær skyldur sem þeir leggja á ríkið á þessu sviði. Næst er litið til ákvæða íslensku stjórnarskrárinnar og almennra laga er varða vernd barna gegn ofbeldi, með hliðsjón af þjóðréttarlegum skuldbindingum. Að lokum er fjallað um það hvernig ríkið uppfyllir verndarskyldur sínar þegar hagsmunir barna og foreldra vegast á, þar sem óhjákvæmilegt kann að vera að takmarka réttinn til friðhelgi heimilis og fjölskyldu.
    Megin niðurstöður eru þær að íslensk löggjöf hefur að geyma ákvæði sem veita börnum vernd gegn líkamlegu ofbeldi og misnotkun. Kveðið er á um að tryggja skuli börnum sem búa vð ofbeldi nauðsynlega aðstoð, auk þess sem refsingar eru lagðar við því að beita börn ofbeldi eða misnota. Íslenska ríkið virðist að því leyti uppfylla skyldur sínar til að vernda börn gegn ofbeldi samkvæmt alþjóðlegum skuldbindingum.

    The objective of this essay is to investigate childrens protection against violence by Icelandic law and to explore if the Icelandic government has met its international obligations to take reasonable measures to protect children against violence. This essay pays special attention to domestic violence and that caused by parents or ther caregivers, as this type of violence against children is often difficult to identify and complicated for the authorities to address.
    Firstly, the different forms of violence and their consequences are discussed with an emphasis on the importance of child protection. This is followed by a chapter on the international commitments of the government concerning child rights and protection from violence. Particular emphasis is put on discussing The United Nations Convention on the Right of the Child and The European Convention on Human Rights as they are the most significant conventions in this context. The protection of children against violence as defined in the conventions is discussed along with the duties that these impose on the state. The essay also provides a review of the provisions of the Icelandic constitution and general laws concerning the protection of children against violence in regards to international law obligations. Finally, we discuss how the government fulfills its obligations to protect when the interests of the children and the parents are in conflict, and where it may be inevitable to restrict the right to privacy of the home and family.
    The main findings are that the Icelandic legislation contains provisions that protect children against violence and abuse. It also dictates that children who live with violence shall be provided with the necessary assistance, and that punishments are provided against those who subject children to violence or abuse. The Icelandic government appears to fulfill its obligations to protect children against violence under international obligations.
