  • Ritgerðin fjallar um lög um málefni aldraðra á Íslandi og þar er kannað hvaða breytingar þurfi að gera á öðrum lögum ef núverandi sérlög um málefni aldraðra verða felld úr gildi í tengslum við flutning málaflokksins frá ríki til sveitarfélaga. Saga þjónustu við aldraða á tuttugustu öld er rakin með áherslu á þau lög sem sett voru 1982 og 1999 og reifaðar þær hugmyndir um aldraða í samfélaginu sem lágu þar að baki. Samsvarandi lagaumhverfi á Norðurlöndum er lýst í stuttu máli. Helstu niðurstöður eru þær að efnisatriðum sérlaganna eru að miklu leyti gerð skil í öðrum lögum og að við flutning framkvæmdar þjónustu við aldraða til sveitar-félaga sé fremur ástæða til að styrkja þann grundvöll sem þar er til staðar. Líta skuli á málefni aldraðra frá sjónarhóli þarfa hvers einstaklings, í samræmi við þær hugmyndir sem nú eru ræddar um þjónustu við aldraða sem mannréttindamál og skyldu samkvæmt alþjóðlegum samningum og samþykktum.

    This paper deals with the Act on the Affairs of the Elderly in Iceland and examines what changes need to be done on other legislation if the existing special legislation for the elderly will be repealed in connection with the transfer of the affairs from state to local governments. History of services for the elderly in the twentieth century is described, focusing on the laws that were passed in 1982 and 1999 and the concepts of the elderly in the community that lay behind them. The corresponding regulatory environment in the Nordic countries is described briefly. The main findings are that the topics in the special legislation are to a large extent covered in other legislation and in the transfer of services for elderly people to local government there is rather a reason to strengthen the basis of existing laws. The matters of the elderly should be looked at from the perspective of the needs of the individual, in accordance with the current concepts of services for the elderly as a human rights issue and an obligation under international agreements and conventions.
