  • Ritgerð þessi fjallar um atkvæðarétt í veiðifélögum samkvæmt 40. gr. laga nr. 61/2006 um lax- og silungsveiði. Sérstaða atkvæðaréttarins liggur í þeirri meginreglu að hver félagsmaður hefur eitt atkvæði fyrir hvert lögbýli sem hann ræður yfir óháð því hversu stóra hlutdeild hann á í tekjum, gjöldum og eignum veiðifélagsins. Fjallað er um sögu og tilurð ákvæðisins og viðhorf manna á mismunandi tímum til atkvæðaréttarins. Ákvæðið er borið saman við reglur eignaréttar, hvort það skerði eignarétt manna að vægi atkvæða og áhrif innan veiðifélaga fari ekki saman við eign og kostnaðarhlutfall. Ákvæðið er líka borið saman við reglur félagaréttar og þá sérstaklega rétt manna til að standa utan félaga, það er neikvætt félagafrelsi samanber 2. mgr. 74. gr. stjórnarskrárinnar og 11. gr. mannréttindasáttmála Evrópu.

    This essay highlights the voting rights’ in association of river owners under the 40th article of the Icelandic Act no. 61/2006 on Salmon and Trout fishing. Uniqueness of voting rights in association of river owners is principle of the law, meaning that each member has one vote for each land he holds irrespective of how large the share of income, expenses and assets of the association he holds. The essay also examines the history and development of the provision, attitudes of people at different times to the voting rights. The provision is applied to the right of ownership rules whether it restricts the property rights of people with the importance of voting and the impact in the association of river owners does not coincide with their property and expense ratio. The provision is also compared with the rules of company law (association rights), especially the right for members to have negative association freedom set out in the second paragraph of 74th article of the Icelandic Constitution and by the 11th article of the European Convention on Human Rights.
