  • Leitast er við að lýsa í ritgerð þessari hvaða heimildir yfirvöld hafa til að framkvæma beitingu álags sbr. 108. gr. laga um tekjuskatt nr. 90/2003 með hliðsjón af reglum stjórnsýsluréttarins og í kjölfar endurákvörðunar skatta. Skoðaður er munur á skatteftirliti, skattrannsóknum og stjórnsýsluframkvæmd við álagningu skatta almennt. Rýnt verður í tvo dóma Hæstaréttar Íslands, álit umboðsmanns Alþingis og dóma Mannréttindadómstóls Evrópu, sérstaklega stefnumarkandi dóm í málinu Zolotukhin gegn Rússlandi. Litið verður til meginreglunnar um tvöfalt refsinæmi (l. ne bis in idem, í. ekki tvisvar fyrir það sama) út frá tvöföldu kerfi málsmeðferðar og viðurlaga í skattamálum á Íslandi sbr. 1. mgr. 4. gr. 7. viðauka Mannréttindasáttmála Evrópu. Greint verður frá þróun réttarins í Noregi og Svíþjóð í kjölfar hins svokallaða Zolotukhin-dóms. Að lokum verður sett fram niðurstaða um rannsóknarefni ritgerðarinnar.

  • In this thesis the author seeks to describe the means that the authorities have to implement the application of tax surcharge according to article 108. of the Income Tax Act no. 90/2003, and the rule use of the administrative law, following a tax re-assessment. The differences of tax control, tax research and administrative practice of levying taxes in general will be examined. A review will be made of two judgments of the Supreme Court of Iceland, the opinion of the parliament Ombudsman and European Court judgments, particularly a strategic verdict in the case of Zolotukhin against Russia. The principle of dual criminality procedure or the „ne bis in idem“ (not twice for the same) rule will be looked upon in relation to the dual system of procedures and penalties for tax in Iceland, (acc. to the first paragraph. 4. Article of the 7. Annex to the European Human Rights Convention). Recent development of the legal interpretation of the Supreme Court of both Norway and Sweden, in the wake of the so-called Zolotukhin-case will be studied. Finally an answer of the thesis research topic will be laid out.
