  • Á 57. fundi mannréttindaráðs Reykjavíkur, þann 12. október 2010, var lögð fram tillaga meirihluta ráðsins að reglum um samskipti leik- og grunnskóla Reykjavíkurborgar og trúar- og lífsskoðunarhópa. Tillagan tók þó nokkrum breytingum í langri málsmeðferð, uns hún hlaut samþykki borgarstjórnar Reykjavíkur þann 4. október 2011. Skóla- og frístundasviði Reykjavíkurborgar var falið að skipa nefnd sem meta skyldi reynslu af reglunum innan árs frá setningu þeirra og er sá reynslutími ekki liðinn er þetta er ritað.
    Umrædd tillaga hefur sætt mikilli gagnrýni og hefur henni verið jafnað við aðför að íslensku samfélagi og menningu þess. Meginmarkmið tillögunnar var að banna meint trúboð í skólum. Í ljósi þessa verður leitast við að svara þeirri spurningu hvort hinar nýsamþykktu reglur útiloki hefðbundin samskipti kirkju og skóla og hver aðdragandi og grundvöllur upphaflegu tillögunnar hafi verið. Í þeim tilgangi verður farið yfir samskipti kirkju og skóla á 20. öldinni fram til dagsins í dag og núgildandi mannréttindastefnu Reykjavíkurborgar, auk þess sem kynntar verða samtíma hugmyndir um hlutleysi í skólastarfi. Sjónum verður beint að inntaki alþjóðlegra trúfrelsisákvæða ásamt þjóðréttarlegum skuldbindingum Íslands og verður í því sambandi stuðst við dómaframkvæmd Mannréttindadómstóls Evrópu og álit Mannréttindanefndar Sameinuðu þjóðanna.
    Helstu niðurstöður eru þær að upphaflegri tillögu mannréttindaráðs Reykjavíkur hafi verið ætlað að breyta samskiptum kirkju og skóla á þann hátt að hefðbundin aðkoma trú- eða lífsskoðunarfélaga yrði útilokuð frá skólastarfi í Reykjavíkurborg. Stefnan var tekin á algjört hlutleysi ríkis í skólastarfi í anda veraldarhyggju. Sú hugmynd gengur þvert á almennt viðurkennd sjónarmið um tengsl ríkis og menningararfs, sem íslensk stjórnvöld hafa kosið að aðhyllast (kennd við efnislega óhlutdrægni - e. substantive impartiality) og virðist fátt benda til þess að háværar kröfur séu um slíkt hlutleysi í íslensku samfélagi nútímans. Þrátt fyrir að upphafleg tillaga meirihluta mannréttindaráðs hafi ekki hlotið brautargengi í óbreyttri mynd, má merkja vissa útilokun á hefðbundnum samskiptum kirkju og skóla með núgildandi reglum um samskipti leik- og grunnskóla og frístundaheimila Reykjavíkurborgar við trúar- og lífsskoðunarfélög.

    On the 57th meeting of the Human Rights Council of Reykjavík City, 12 October 2010, the council’s majority submitted a proposal for rules, regarding relations between public kindergartens and elementary schools, on the one hand, religious groups and groups with philosophical convictions, on the other. The proposal changed considerably in the long procedure until it received approval by the City Council on 4 October 2011.
    The Department of Education and Youth was entrusted with forming a committee that would evaluate the experience of the rules, within one year of their enactment. The trial period is not over, as of this writing. The said proposal has been subject to harsh criticism, such as being equated with an attack on Icelandic society and culture. The main objective of the proposal was to prohibit alleged mis-sionary work in schools.
    In this thesis, besides scrutiny on the foundation of and the events leading up to the making of original proposal, it will be examined whether the adoption of the rules precludes traditional relations of the established church and public schools. For this purpose, the thesis includes a short overview on the relations of the established church and schools in the 20th century until the present day and a discussion on the current human rights policy of the City of Reykjavík. Furthermore, there will be an introduction to contemporary ideas of neutrality in public education. In light of this, the focus will be on what consist in the international provisions on freedom of religion and belief, with respect to the international obligations of Iceland, together with examples of relevant case law of the European Court of Human Rights and decisions of the United Nations Human Rights Committee.
    The main conclusions are that the original proposal, by the majority of the Human Rights Council of Reykjavík City, was designed to exclude the established church and other religious groups, or groups with any philosophical convictions, from all activities in kindergartens and public compulsory education in Reykjavík. The aim was absolute neutrality of the state regarding public education, in the spirit of secularism. This is contrary to commonly accepted views on the relationship between state and its cultural heritage, which the Icelandic government has chosen to endorse (namely, substantive impartiality) and has not met strong opposition in the modern Icelandic society to date.
