  • Umfjöllunarefni ritgerðarinnar er hin forna regla íslensk réttar um að eignarhaldi á landi fylgi veiðiréttur í vatni á eða fyrir því landi, sbr. nú 1. mgr. 5. gr. laga um lax- og silungsveiði, nr. 61/2006. Í upphafsköflum ritgerðarinnar er stiklað á stóru yfir hugtök eins og eign og eignarréttindi, auk þess sem höfundur gerir fasteignum almenn skil. Því næst er sögulegt yfirlit yfir meginreglu 1. mgr. 5. gr. laga nr. 61/2006.
    Í ritgerðinni er fjallað um veiðirétt við uppskiptingu fasteigna. Umfjöllun um uppskiptingu fasteigna í séreign er tvíþætt og beinist að skiptingu fyrir og eftir gildistöku vatnalaga, nr. 15/1923. Fyrir gildistöku laganna voru engin ákvæði í íslenskum rétti sem takmörkuðu aðskilnað á veiðirétti frá landareign. Við sölu á hluta úr séreign fyrir gildistöku vatnalaga hafa dómstólar þar af leiðandi litið svo á að veiðiréttur hafi fylgt hinu selda landi nema kveðið hafi sérstaklega á um hið gagnstæða í afsali. Eftir gildistöku vatnalaga og fram til gildistöku laga nr. 61/2006 var óheimilt að skilja veiðirétt frá landareign. Við sölu á hluta úr séreign var þannig ekkert í lögum því til fyrirstöðu að veiðiréttur yrði skilinn frá fasteign sem féll ekki undir hugtakið landareign í skilningi lax- og silungsveiðilaga. Samkvæmt lögum nr. 61/2006 verður veiðiréttur nú ekki skilinn frá fasteign nema að uppfylltum nánar tilgreindum skilyrðum.
    Eftir landskipti á fasteign í óskiptri sameign helst veiðiréttur á hendi allra sameigenda nema staðbinding veiðiréttinda sé samþykkt af öllum sameigendum, sbr. 1. mgr. 3. gr. landskiptalaga, nr. 46/1941. Að lokum fjallaði höfundur um flutning veiðiréttar til fasteignar sem á hvergi liggur að vatni. Nú til dags er útilokað er að vinna ítak í veiðirétti fyrir landi annars manns samkvæmt hefðarlögum, nr. 46/1905, enda hafi ákvæði vatnalaga um skorður á aðskilnaði veiðiréttar frá landareign girt fyrir stofnun veiðiréttar með þessum hætti.

    The objective of this thesis is to examine a common principle in Icelandic law, which states that the right to salmon and trout fishing in freshwater is included in the ownership of a land, cf. par. 1 art. 5 in the Act of Salmon and Trout Fishing, No. 61/2006. In the introductory chapters, the author briefly explains the meaning of concepts like property, proprietary rights and real property. The author then traces the historic background of par. 1. art. 5. of Act No. 61/2006.
    The author examines the fishing rights after a real property is divided and covers the topic before and after the Water Act No. 15/1923 entered into force. If a private property was divided before the Water Act entered into force and a part of the property sold, courts have confirmed that fishing rights were included in the sale unless a clear provision in the contract agreement stated to the contrary. After the Water Act came into effect and until Act No. 61/2006 entered into force the seperation of fishing rights was forbidden from a land. If a real property was not considered to be a land according to the salmon and trout legislation at the time of the seperation, the seperation of fishing rights is thought to be legitimate.
    After a land in joint property is divided the fishing right remains in the property of each owner of the joint property before it was divided, except if every owner agrees otherwise. In the final chapter the author examines circumstances where a land obtains fishing rights in freshwater, even though it‘s boundaries do not reach water. Since the Water Act entered into force and banned the seperation of fishing rights from a land it is now impossible to obtain fishing rights for another man‘s land.
