  • Þessari ritgerð er ætlað að kortleggja þær reglur sem gilda um heilbrigðisþjónustu yfir landamæri í evrópurétti. Heilbrigðisþjónusta yfir landamæri felur í sér að sjúklingur eða þjónustuveitandi ferðast til annars aðildarríkis Evrópusambandsins í þeim tilgangi að móttaka eða veita heilbrigðisþjónustu. Evrópudómstóllinn hefur staðfest að þjónusta sem þessi falli undir þjónustufrelsið í skilningi ákvæða 56.-57. gr. Sáttmálans um framkvæmd ESB. Í ritgerðinni er reynt að varpa ljósi á umgjörð og regluverk slíkrar tegundar heilbrigðisþjónustu og hvernig hún hefur birst í framkvæmd. Í því ljósi eru skoðaðir nokkrir grundvallardómar Evrópudómstólsins á þessu sviði og hvernig þeir hafa mótað og haft áhrif á framkvæmdina. Helstu niðurstöður dómstólsins sýna að sjúklingur á að meginstefnu til rétt á að fá heilbrigðisþjónustu yfir landamæri endurgreidda frá heimaríkinu. Í sumum tilvikum getur heimaríkið þó neitað sjúklingnum um endurgreiðslu nema hann hafi fengið heimild til að sækja þjónustuna. Í ritgerðinni er fjallað um þau tilvik þar sem hægt er að krefjast áðurfenginnar heimildar. Í ritgerðinni er einnig fjallað um tilskipun 2011/24 um réttindi sjúklinga í heilbrigðisþjónustu yfir landamæri og samsvörun hennar við dóma Evrópudómstólsins. Loks er sjónum beint að Íslandi, sem ekki er aðili að Evrópusambandinu þegar þessi ritgerð er skrifuð, hvort og þá af hverju sömu reglur gildi hér á landi, hugsanleg áhrif tilskipunar 2011/24 og tækifæri Íslands í heilbrigðisþjónustu yfir landamæri.

    The subject of this essay is cross-border healthcare in the European Union. Cross-border healthcare is when a healthcare provider or a patient travels from their home state to another Member State of the European Union to receive or provide healthcare services. The European Court of Justice has decided that healthcare services fall under the scope of articles 56-57 of the Treaty of the Functioning of the European Union, which entail the freedom to provide services. This essay is intended to shed light on the rules concerning this sort of service and how they present themselves in practice. To achieve this, a few main judgements of the Court are considered and shown how they have affected cross-border healthcare. Generally, the judgements imply that patients have the right to get costs from cross-border healthcare reimbursed from their Member State of affiliation. In some cases though, the Member State may refuse to reimburse the costs unless the patient has been granted prior authorisation. This essay therefore includes what kind of healthcare can only be reimbursed if the patient has been given a prior authorisation. It is also discussed how a new directive from the European Union, Directive 2011/24, clarifies the rules about patients’ rights in cross-border healthcare and its resemblance to the judgements of the Court. In the last chapter, the spotlight is set on Iceland, which is not a Member State of the European Union at the time this essay is written. It is therefore considered if and why the same rules apply to Iceland and the Member States of the European Union and how Directive 2011/24 affects Iceland and its chances to start a new branch of tourism, the so-called healthcare tourism.
