  • Í ritgerðinni er fjallað um sögu samkeppnisreglna með áherslu á reglur um misnotkun á markaðsráðandi stöðu og þá sérstaklega 102. gr. TFEU (áður 82/86. gr. RS). Þá er einnig fjallað um kenninguna um samkeppni og þær stefnur sem mest áhrif hafa haft á réttarframkvæmd teknar til nánari skoðunar. Loks er fjallað um leiðbeiningu framkvæmdastjórnarinnar um forgangsröðun og áherslur stofnunarinnar við beitingu 102. gr. TFEU varðandi útilokandi háttsemi markaðsráðandi fyrirtækja. Leiðbeiningin er liður í nútímavæðingu framkvæmdastjórnar ESB á samkeppnisreglum sambandsins en meginmarkmið hennar er að auka svokallaða hagfræðilega nálgun við úrlausn samkeppnismála.
    Markmiðið með ritgerðinni er að sýna fram á tengsl sögu 102. gr. TFEU við þróun túlkunar reglunnar bæði hjá framkvæmdastjórninni og dómstólum ESB. Þá er það einnig ætlunin að rannsaka hvaða áhrif framangreind leiðbeining framkvæmdastjórnarinnar hefur haft og mun hafa á réttarframkvæmd í ákvörðunum framkvæmda-stjórnar ESB, ákvörðunum innlendra samkeppnisyfirvalda á EES-svæðinu, dómum dómstóla ESB og EFTA og dómum innlendra dómstóla á EES-svæðinu.
    Komist er að þeirri niðurstöðu að samkeppnisreglur ESB og þá sérstaklega 102. gr. TFEU byggi í grunninn á þýskum hugmyndum um samkeppnisrétt og þá aðallega kenningu Ordoliberalismans (í. reglu-frjálshyggja, þýð. höf.) og hugmyndinni um félagslegt markaðshagkerfi. Niðurstaðan varðandi áhrif leiðbeiningarinnar var sú að hún hafi ekki haft teljandi áhrif til þessa en að nútímavæðing framkvæmdastjórnarinnar og aukin áhersla á efnahagslega nálgun hafi haft nokkur áhrif. Sem dæmi um slík áhrif má nefna að dómstólar ESB hafa viðurkennt möguleika markaðsráðandi fyrirtækja til að beita hagræðingu sem vörn í málum sem varða 102. gr. TFEU. Loks var komist að þeirri niðurstöðu að leiðbeiningin kunni að skapa réttmætar væntingar fyrir markaðsaðila. Því geti framkvæmdastjórnin líklega ekki vikið frá reglum leiðbeiningarinnar án rökstuðnings og sérstakra aðstæðna.

    This paper discusses the history of competition rules with an emphasis on rules regarding abuse of a dominant position and particularly Article 102 TFEU (formerly Article 86 EEC and Article 82 EC). It also discusses the concept and theory of competition, and takes a closer look at certain schools of competition that have had a particular effect on the judicial process. Finally the Commission's guidance paper on enforcement priorities in applying Article 82 EC to abusive exclusionary conduct by dominant undertakings is examined. The guidance paper is a part of the European Commission's scheme to modernize the competition rules of the Union. The aim of the modernization process is to introduce a more economic approach to the interpretation of the rules on competition.
    The purpose of this essay is to demonstrate the relationship between the history of Article 102 TFEU and the interpretation of the article by the Community Courts and the Commission. It also intends to examine the effects that the above mentioned guidance paper has had and will have on the judicial process of the Commission, the Community Courts, the EFTA Court, the national courts and the national competition authorities.
    The paper concludes that the Community rules on competition and in particular Article 102 TFEU has its origins in the German concept of competition law, particularly the theory of Ordoliberalism and the idea of a social market economy. The conclusion regarding the impact of the guidance paper is that it has not had significant consequences to date. However the Commission's ambition to increase the use of the so called more economic approach has had some effects. As an example of those effects one can mention that the Community courts have recognized that dominant undertakings may be able to justify conduct leading to foreclosure of competitors on the grounds of efficiencies that are sufficient to guaranty no net harm to consumers. Lastly it was concluded that the guidance paper may produce legitimate expectations for undertakings. If the Commission intends to deviate from the guidance paper in an individual case it will probably have to give reasons.
