  • Ritgerðin skiptist í tvo hluta. Fyrri hlutinn fjallar um formskilyrði refsiábyrgðar óháð sönnun en seinni hlutinn um sönnun í sakamálum. Í báðum hlutum er sérstök áhersla lögð á vafa til handa sökuðum manni. Í hefðbundinni kennslu í refsirétti og sakamálaréttarfari kemur fram að sakborningur eigi að njóta vafans í sakamálum og ekki megi leggja sönnunarbyrðina á hann. Minna fer hins vegar fyrir umfjöllun um hvaða vafa nákvæmlega átt er við og hvenær sönnunarbyrðinni hefur ranglega verið velt á sakborning, í ritgerðinni kallast síðastnefnt „öfug sönnunarbyrði“. Í íslenskum fræðiritum er heldur ekki að finna heildstæða umfjöllun á einum stað um hin margvíslegu formskilyrði refsiábyrgðar óháð sönnun. Ritgerðin byggir að mestu á skoðun dóma og leitast er við að ná utan um fyrrnefnd álitaefni, þ.e. formskilyrði refsiábyrgðar eru tekin saman og greind, fjallað er ítarlega um sönnun í sakamálum, skoðað hvaða vafa ber að skýra sökuðum manni í hag og hvenær telja megi með réttu að sönnunarbyrði hafi verið snúið við.
    Við skoðun á fyrrgreindum formskilyrðum kom í ljós að þau eru nokkuð umfangsmeiri, og beiting þeirra mun flóknari, en í fyrstu mætti ætla. Einnig hafa dómafordæmi Mannréttindadómstóls Evrópu mikil áhrif á þetta svið svo sem önnur í sambandi við sakamál. Í umfjöllun um sönnun og öfuga sönnunarbyrði er rökstutt að ekki er til neinn fastur eða áþreifanlegur punktur sem markar lok fullnægjandi sönnunar og upphaf öfugrar sönnunarbyrði. Rauði þráðurinn gegnum báða hluta ritgerðarinnar er eins og áður segir, skoðun á vafa í þágu sakbornings. Niðurstaða þeirrar skoðunar er að sé í sakamáli svigrúm til mats dómara á annaðhvort forms- eða efnisatriðum máls þá beri við það mat að skýra reglur þröngt og þar með allan vafa sakborningi í hag.

    The essay is divided into two parts. The first part considers the formal preconditions for criminal liability independent of proof, whereas the second part deals with proof in criminal proceedings. In both parts special emphasis is placed on the benefit of the doubt for the accused. According to traditional teaching in criminal law and criminal justice, the accused shall enjoy the benefit of the doubt in criminal cases and it is impermissible to place the burden of proof on him. There is less discussion about the precise nature of the doubt at issue and when the burden of proof may be said to have been wrongfully placed on the accused, or what in this essay is termed reverse burden of proof. Also, in Icelandic scholarly publications no comprehensive discussion is found in one place about the diverse formal preconditions of criminal liability independent of proof. The essay is for the most part based on a review of adjudications and an attempt is made to cover the above issues, i.e. the formal preconditions of criminal liability are summarised and analysed, proof in criminal proceedings is discussed in detail and the kinds of doubt which must benefit the accused are examined together with the question of when it is appropriate to consider the burden of proof having been reversed.
    A review of the above formal preconditions revealed that they are considerably more extensive, and their application more complicated, than might at first be assumed. Also, the case law of the European Court of Human Rights has a great impact in this, as in other fields relating to criminal proceedings. In the discussion on proof and reverse burden of proof, it is argued that in any specific case the precise point at which satisfactory proof ends and reverse burden of proof takes over cannot be specified. As noted before, a review of doubt that may benefit the accused is the central issue of both parts of the essay. The conclusion of that review is that, when there is leeway in a criminal proceeding for a judge to assess either formal or substantive aspects of a case, the rules must be interpreted narrowly and the accused must enjoy the benefit of all doubt.
