  • Í ritgerðinni er fjallað um forvirkar rannsóknarheimildir lögreglu og leitast við að svara þeirri spurningu hvort ástæða sé til að lögfesta slíkar heimildir.
    Í fyrri hluta ritgerðarinnar er fjallað almennt um hlutverk og heimildir lögreglu. Jafnframt er fjallað um rannsókn sakamála, markmið rannsóknar og heimildir lögreglu til að hefja rannsókn sakamála. Til skoðunar koma helstu rannsóknaraðferðir, sem lögreglu er heimilt að grípa til við rannsókn sakamála.
    Almenn umfjöllun er um skipulagða glæpastarfsemi og skilgreiningu á hugtakinu skipulögð glæpastarfsemi í íslenskum lögum. Auk þess er gerð grein fyrir stöðu skipulagðrar glæpastarfsemi á Íslandi.
    Í seinni hlutanum er fjallað um réttinn til friðhelgi einkalífs og með hvaða hætti rétturinn er varinn í íslensku lagaumhverfi. Skoðuð eru skilyrði sem heimila takmörkun á réttinum til friðhelgi einkalífs og þau grundvallarviðmið sem stuðst er við. Jafnframt er gerð grein fyrir grundvallarsjónarmiðum og reglum um persónuvernd.
    Í umfjöllun um forvirkar rannsóknarheimildir lögreglu er leitast við að gera grein fyrir hvað felist í forvirkum rannsóknarheimildum. Gerð er grein fyrir þeim andstæðu sjónarmiðum sem komið hafa fram um forvirkar rannsóknarheimildir lögreglu.
    Að mati höfundar má færa gild rök með og á móti því að lögfesta forvirkar rannsóknarheimildir lögreglu. Hægt er að viðurkenna ógnina sem stafar af skipulagðri glæpastarfsemi og fallast á að nauðsynlegt sé að veita lögreglu víðtækari heimildir. Hins vegar verður að hafa í huga að friðhelgi einkalífs er með mikilvægustu réttindum borgaranna og verða þau réttindi ekki skert nema að uppfylltum ströngum skilyrðum. Ef lögfesta á forvirkar rannsóknarheimildir þurfa lagaheimildir að vera skýrar og tryggja þarf að lögreglan hafi ekki of rúmar heimildir til að ákveða beitingu rannsóknaraðgerða. Réttarfarsleg úrræði þurfa einnig að vera til staðar til að bregðast við mögulegri misnotkun. Rétt er að setja slíkum heimildum þröngar skorður í lögum og áskilja dómsúrskurð í hverju tilviki.

    This paper discusses the police’s proactive investigation powers and seeks to answer the question of whether such powers should be adopted into law.
    The first part of the paper discusses the role and powers of the police in general terms. Also discussed are the investigation of criminal cases, investigation goals and the police’s authorisation to initiate investigations into criminal cases. The main investigative techniques that the police may use to investigate criminal cases are examined.
    This section contains a general discussion on organised crime and the manner in which the term organised crime is defined in Icelandic law. In addition, the section describes the status of organised crime in Iceland.
    The second part of the paper discusses the right to freedom from interference with privacy, home and family life and the manner in which such rights are protected in Icelandic law. An examination is made of the conditions that permit limitations to the right to freedom from interference with privacy, home and family life and the basic criteria on which it is based. The basic views and rules on protection of privacy are also described.
    In the discussion of the police’s proactive investigation powers, an attempt will be made to explain what such powers entail. A description is given of the opposing views that have been aired about the police’s proactive investigation powers.
    In the opinion of the author, there are compelling arguments for and against adopting proactive investigation powers for the police into law. One can recognise the threat organised crime poses and agree to the necessity of providing the police with broader powers. However, it must be kept in mind that the right to freedom from interference with privacy, home and family life is one of the most important rights a citizen can have and that such rights cannot be curtailed except on the fulfilment of strict conditions. If proactive investigation powers are to be adopted into law, such powers must be clearly defined and it must be ensured that the police do not have too extensive an authorisation to decide on the use of investigative actions. Moreover, judicial mechanisms must be in place to respond to possible abuses. Legislation should severely limit such powers and should require a court ruling in each case.
