  • Meginmarkmið ritgerðarinnar er að skoða forsjársviptingar samkvæmt barnaverndarlögum nr. 80/2002 og hvernig þeim er beitt lögum samkvæmt. Í upphafi ritgerðar er barnaréttur kynntur, staðsetning hans innan fræðikerfis íslenskrar lögfræði og farið yfir þróun hans frá aldamótum 1900 til ársins í dag. Kynnt verða brottfallin barnaverndarlög nr. 58/1992 og núgildandi barnaverndarlög nr. 80/2002 með hliðsjón af forsjársviptingum, hvað inntak forsjár er sbr. barnalögum nr. 76/2003 og hverjar forsjárskyldur foreldra eru lögum samkvæmt. Hæstaréttardómar voru reifaðir er fjalla um forsjársviptingar samkvæmt brottföllnum og núgildandi barnaverndarlögum.
    Niðurstöður þeirra voru í flestum tilfellum forsjársvipting annars eða beggja foreldra og þeim gefið tækifæri á að bæta sig áður en komið var til forsjársviptingar. Í öðrum tilfellum voru mæður fyrrverandi skjólstæðingar barnaverndarnefnda og eru á ný undir eftirliti vegna barna þeirra. Í tveimur Hæstaréttardómum kom fram gagnrýni héraðsdóms á vinnubrögðum barnaverndarnefnda í forsjársviptingarmálum.

    The main objective of the thesis is to review custody deprivation under the Icelandic Child Protection Act. No. 80/2002 and how it has been applied in practice. The thesis begins with an introduction of the rights of children in the Icelandic legal and Academic system and how they have developed from the 19th Century to present time. Following this, the repealed Child Protection Act, No. 58/1992 and the current Child Protection Act. No. 80/2002 will be examined in light of custody deprivations. The concept of custody and the responsibility and obligations of parents will be explained under the Icelandic Children Act No. 76/2003. For explanatory purposes several Supreme Court judgments dealing with deprivation of custody are recapitulated.
    The results of the judgments were that one or both parents were offered the opportunity to improve their lives prior to the deprivations of custody. In some cases mothers were former clients of the welfare system and were now under supervision of the Child welfare system because of their children. Two Supreme Court judgments criticized in particular the Child Welfare Authority’s methods in cases concerning the deprivation of custody.
