  • Markmið þessarar ritgerðar er að skoða gallahugtakið í lausafjár- og neytendakaupum. Skilin á milli neytenda og lausafjárkaupa eru oft á tíðum ekki ýkja mikil og því verður spjótum beint að báðum lagabálkunum jöfnum höndum. Í upphafi mun hugtakið galli vera útskýrt, bæði skv. kenningum fræðimanna sem og skv. skilgreiningu laganna.
    Lítillega er fjallað um gildissvið laganna, sem gilda um flest öll viðskipti önnur en fasteignaviðskipti.-
    Aðaláhersla ritgerðarinnar mun verða á að skoða þætti kaupanda og seljanda þegar metið er hvort hlutur sé haldinn galla, þ.e. skoðunarskyldu kaupanda og upplýsingaskyldu seljanda. Þeirri spurningu er velt upp hvort skoðunarskylda kaupanda takmarkist af upplýsingaskyldu seljanda, eða hvort upplýsingaskylda seljanda takmarkist af skoðunarskyldu kaupanda. Þá er fjallað um háttsemi kaupanda og seljanda fyrir og eftir kaup og hvaða áhrif hún getur haft þegar metið er hvort galli er eða hafi verið til staðar. Einnig er þeirri spurningu velt upp hvort mögulegt sé fyrir kaupanda að semja sig frá því að geta borið fyrir sig galla með því að undirrita almenna samningsskilmála.
    Af niðurstöðum þeirra dóma Hæstaréttar og álita kærunefndar lausafjár- og þjónustukaupa sem tekin voru til skoðunar, má leiða að því líkum að undanfarið hafi krafan um upplýsingaskyldu seljanda orðið meiri og meiri og réttur kaupanda þar af leiðandi sterkari.

  • The object of this thesis is to examine the defective concept in liquidity and consumer purchases. The distinction between consumers and credit purchase is often unclear and therefore the focus will be equal on both of the Consolidation Acts. Initially, the concept of fault will be explained from theoretical point of view as well as by the definition of the law.
    The scope of the Act will briefly be analysed, which can be applied to most business transactions with the exception of real estate.
    The attention will be on examining the roles of the buyer and the seller when assessing whether or not a fault is involved in relation to inspection obligations of the buyer’s and the sellers’ disclosure. Looking at whether the current inspection duty of the sellers’ disclosure can be limited by the inspection obligation of a buyer or if the buyer’s inspection obligation can be restricted by mandatory inspection of the seller. The question is also about integrity and whether the responsibility lies more on the current inspection duty of the seller or of the buyer and if a fault has been present or not. Also is it possible for the buyer to negotiate himself from being able to invoke the bug by signing a general contract.
    From the results of the Supreme Court and the Appeals Committee of liquid and Services that have been taken under consideration it can be surmised that recently the demand for the seller’s disclosure has become more and more and the buyer’s right consequently stronger.
