  • Markmið þessarar ritgerðar er að kanna hvað dómstólar leggja til grundvallar þegar meta þarf sakhæfi manna vegna afbrota sem þeir hafa framið og efasemdir eru um hvort þeir hafi á verknaðarstundu, verið alls ófærir um að stjórna gjörðum sínum. Einkum verður horft til þess hvernig læknisfræðilegt sakhæfi er skilgreint svo og lögfræðilegt sakhæfi og hvernig það er metið með hliðsjón af þeim lagaákvæðum sem í gildi eru. Ennfremur er litið til þeirra öryggisúrræða sem krafist er þegar menn eru dæmdir ósakhæfir af dómstólum og framkvæmd á lausn þeirra þar sem skilyrðin um lausn eru þau sömu og liggja að baki ákvörðun dómstóla um ósakhæfi.
    Til að varpa ljósi á hvernig þetta er metið var byrjað á því að skyggnast í þá grunnfræði sem liggur að baki refsiheimildum refsiréttarins og stuttlega gerð grein fyrir þeim ásamt því að fara yfir sakhæfisákvæði hegningarlaganna. Þá var gerð úttekt á þeim helstu læknisfræðilegu geðrænu kvillum sem geta valdið ósakhæfi og reynt að gera þeim ágætis skil, bæði með heimildarvinnu og viðtali við yfirlækni geðlækninga á Landspítalanum Háskólasjúkrahúsi, en hans svið er öryggis- og réttargeðþjónusta við spítalann. Til að kanna hvað dómstólar leggja til grundvallar ósakhæfis var gerð dómarannsókn á Hæstaréttardómum frá árinu 1920 til 2013 og allir þeir dómar teknir saman þar sem reyndi á sakhæfisákvæði hegningarlaganna. Rýnt var í geðrannsókn ákærða og niðurstöður réttarins og ályktanir dregnar út frá þeirri rannsókn, hvað dómstólar leggja til grundvallar slíku mati. Ásamt þessu var svo rætt við Hæstaréttardómara og héraðsdómara um efnið og að endingu farið í þau úrræði sem beitt er gagnvart einstaklingum sem metnir eru ósakhæfir af dómstólum og lausn þeirra.
    Helstu niðurstöður ritgerðarinnar eru að geðlæknar og aðrir matsmenn sem sérhæfa sig í geðlæknis- og sálfræðilækningum, virðast hafa rýmri túlkun á sakhæfi heldur en dómstólar sem setja ósakhæfisákvæði hegningarlaganna, vegna geðrænna annmarka, þröngar skorður. Af dómarannsókn mátti einnig draga þá ályktun að Hæstiréttur lítur til nokkurra þátta þegar hann metur sakhæfi manns og eru það þá helst; aðdragandi verknaðar, verknaðurinn sjálfur, skynbragð á verknaði, hegðun í kjölfar verknaðar og vitnisburður um hegðun og ástand sakbornings í kjölfar atburðar.
    Á heildina litið var fremur erfitt að átta sig á því með nokkurri vissu hverju dómstólar fara eftir og virðast þeir að mestu stóla á þær matsskýrslur sem liggja fyrir í málunum, um sakhæfi manna og kvenna sem gerast sek um afbrot. Af því leiðir að matsskýrslur um geðhagi sakborninga er mikilvægt sönnunargagn í slíkum málum og því nauðsynlegt að slík möt séu vel úr garði gerð en engin lög, reglugerðir eða reglur eru til í dag sem segja til um hvernig meta skal sakhæfi einstaklinga.

    -Insanity valuation in criminal cases-
    The purpose of this thesis is to examine what fundamental guidelines Supreme Court sets when he evaluates the sanity or insanity of a person who has been charged for a grave crime and assessment has been made by a psychiatrist on the persons mental health. Particularly, a medical valuation for insanity will be defined versus the legal definition on insanity and how it is valuated in context with the law. Furthermore safety precautions such as security custody will be examined which the prosecution usually demands and the court rules of, when a person is found to be insane at the time of the crime. The reason why it is necessary to have a brief introduction on that matter is because the same assessment has to be made on the person when she or he demands a release from security custody after undisclosed period of time.
    To explain the methodology of my conclusions, recourses were collected from written sources, interviews and also an extensive research on criminal judgments where there had been a valuation on the accused person´s mental health. First step were to explain the fundamental stipulation behind the criminal legislation and then a short brief made on the provisions in the criminal law that apply on weather a person shall be punished for it´s crime. Second step was to define the main mental illnesses that can cause such conditions on a person’s state of mind that he or she will not be made accountable for it´s actions. Third step towards a conclusion on what the Supreme Court sets as ground rules for whether person should be found insane or insane by a legal definition, the research criteria on criminal judgments was set from the year 1920 to this day, and the focus set on the mental assessment on the accused person and the courts conclusion in the judgments. The third step was to briefly examine the conditions for a release from security custody. The reason is because, if a person who has been found guilty of a crime and was not punished for it´s actions on the ground of insanity, the person has to be proven sane to get released, and has to go through another valuation on it´s sanity.
    The results of this study show that psychiatrists and psychologists, who specialize in assessing accused’s person´s state of mind at the time of the crime, seem to have a wider interpretation on weather a mental illness should lead to a penal dismiss. The Supreme court on the other hand interpreters a person´s mental illness, at the time of the crime, in a narrower perspective. Furthermore the research on Supreme Court´s judgments showed that the court does not only take in to account the persons mental state but also preparation of the crime, the crime it self, knowledge that the act was wrong, behavior after the crime and testimony of behavior and condition shortly after the crime.
    When taken together it cannot be said with absolute certainty what Supreme Court sets as ground rules when evaluating whether a person accused of a crime was sane at the time of it´s acts and, therefore, criminally responsible for the wrongdoing. It seems they evaluate and depend on the mental assessment on the accused when such assessment is among the evidence in cases, and there for a assessment like that is a very crucial evidence. For that reason it is highly important that assessments are well constructed, thorough and the argumentation is outstanding, but presently there are no laws, rules or regulations that define how such valuation should be executed.
