  • Útboðstilskipun Evrópusambandsins 2004/18/EB færði kaupendum í Evrópu nýtt innkaupaferli, samkeppnisviðræður, sem hafði í för með sér meiri sveigjanleika en áður hafði þekkst, með tilheyrandi heimild til viðræðna við þátttakendur. Tilskipunin hefur þó jafnframt haft í för með sér ágreining um inntak og umfang heimilda og hefur túlkun ákvæðanna verið mismunandi eftir ríkjum og tekið mið af gildum þeirra og réttarkerfum auk venja í hverju ríki. Í desember 2011 voru lagðar fram tillögur að endurbótum ákvæðanna af hálfu framkvæmdastjórnar Evrópusambandsins sem taka að hluta á þeim óskýrleika sem eldri tilskipun hafði í för með sér. Víða hafa verið gefnar út leiðbeiningar af hálfu opinberra aðila og annarra sérfræðinga til að skýra álitaefni og leggja grunn að viðurkenndri framkvæmd, sem ekki er tekið á í lögum. Hér á landi hefur notkun samkeppnisviðræðna verið afar takmörkuð. Þar sem sömu reglur gilda hérlendis og annars staðar í Evrópu eru líkur á að sömu ágreiningsefni komi upp hér á landi og því megi læra af reynslu annarra ríkja. Í ritgerð þessari er leitast við að greina hin fjölmörgu álitaefni, skoða reynslu annarra þjóða, viðbrögð þeirra við óskýrleika tilskipunarinnar og meta hvaða aðgerðir gætu komið að gagni hérlendis til að tryggja örugga og viðurkennda notkun samkeppnisviðræðna.

    The Public sector´s directive 2004/18/EC brought a new procedure of public procurement in Europe, called competitive dialogue. The procedure was considered an improvement providing for a desired flexibility such as an authorization to discuss all aspects of the contract. The directive however evoked difference of opinion of the scope and definition of the directive´s provisions. The interpretation of the European Union´s states has also differed and subsequently the scope and definition of the provisions is not the same in all the member states. It has however formed in consideration of practice and difference in legal heritage. The European Commission proposed for a new directive on public procurement in December 2011 which covers some of the differences and vagueness of the older directives provisions. In some member states, both the contracting authorities and professionals in the private field have published directions and guidances along with reports covering a review of the use of competitive dialogue in the member states. The purpose has been to clarify some of the vagueness and secure a recognized execution of incomplete legal provisions. In Iceland, the use of competitive dialogue has been limited. Since the same legal provisions are valid in Iceland as elsewhere in Europe it is likely that we face the same problems as EU member states. The intent with this thesis is to analyze the matters of disputes and look at the EU member state´s reactions to the vagueness of the provisions. It will also evaluate the measures we can rely on in order to secure safe and recognized execution of the use of competitive dialogue.
