  • Með ritgerð þessari er ætlun höfundar að kanna að hvaða marki nýlegar breytingar dómaframkvæmd Mannréttindadómstóls Evrópu í málum sem reyna á 1. mgr. 4. gr. 7. viðauka við mannréttindasáttmála Evrópu nr. 62 frá 19. maí 1994, hafi á heimildir íslenskra skattyfirvalda til þess að beita skattgreiðendur viðurlögum í formi fésekta, vegna brota er varða skattaskil þeirra. Þar sem verið er að skoða áhrif 1. mgr. 4. gr. 7. viðauka er nauðsynlegt að gera grein fyrir því hvernig uppsetning skattkerfisins er og hvaða heimildir skattyfirvöld hafa til þess að knýja á um efndir skatttekna. Regla 1. mgr. 4. gr. 7. viðauka við mannréttindasáttmála Evrópu, um tvöfalt refsinæmi, mælir fyrir um bann við endurtekinni málsmeðferð vegna refsiverðrar háttsemi eða tvöfaldri refsingu (l. ne bis in idem). Í ljósi þeirrar gagnrýni sem fram eftir nýlegan dóm Hæstaréttar 22. september 2010 nr. 371/2010, þar sem tekið var fram með berum orðum að vafa gættir um efnisinntak reglunnar. Þar vísaði Hæstiréttur í stefnumarkandi dóm yfirdeildar Mannréttindadómstólsins í máli Zolotukhin gegn Rússlandi en komst að annarri niðurstöðu í túlkun sinni á 1.mgr. 4. gr. 7. viðauka. Þykir ljóst að misræmi gæti á milli skýringar Mannréttindadómstólsins og Hæstaréttar um þá vernd sem fellst í 1. mgr. 4. gr. 7. viðauka, ne bis in idem. Að lokum verður fjallað um með hvaða hætti hefur reynt á regluna fyrir innlendum dómstólum. Í ljósi alls sem fram hefur komið er unnt að fullyrða vafa gætir um fésektarheimildir skattyfirvalda þegar sömu eða nægjanlega sambærileg málsatvik búa að baki annars vegar álagsbeitingu og hins vegar ákvörðun fésektar eða annarra refsinga.

    This essay is intended to explore what effect recent changes in the case-law of the European Court of Human Rights under Article 4 (1) of Protocol No. 7 to the European Convention of Human Rights have on the Icelandic tax authorities imposition of fines in relation to tax offences. It is therefore necessary to describe the organisation of the tax system and the possibilities the tax authorities have to enforce the paying of taxes. Article 4 (1) of Protocol No. 7 to the Convention guarantees the right not to be tried tried or punished again in criminal proceedings under the jurisdiction of the same State for an offence for which he has already been finally acquitted or convicted in accordance with the law (l. ne bis in idem). The Supreme Court’s judgment of 22 September 2010 in the case No. 371/2010, in which the Supreme Court stated that there were doubts as the content of the rule has been criticised. The Supreme Court referred to a leading judgment of the Granc Chamber of the Eruopean Court of Human Rights in the case of Zolotukhin v. Russia but reached another conclusion in its interpretation of Article 4 (1) of Protocol No. 7. It seems clear that there are discrepancies between the interpretation of the European Court and the Supreme Court about the scope of the right that is guaranteed by Article 4 (1) of Protocol No. 7, ne bis in idem. In the light of everything that has been discussed it may be concluded that there is doubt in relation to the possibilities that the tax authorities have to impose fines when the same or substantially the same facts are the bases for the imposition of surcharges, on the one hand, and fines or other punishments, on the other hand.
