  • Lífeyrissjóðir eru bæði mjög stórir fjárfestar á íslenska fjármálamarkaðinum og jafnvel í alþjóðlegum samanburði. Þeir bera ríkar skyldur til eigenda sinna og samfélagsins í heild. Það er því nauðsynlegt að allar reglur um fjárfestingar þeirra séu mjög skýrar og í samræmi við tilgang lífeyriskerfisins. Enginn vafi má vera í þessum efnum, einkum þegar kemur að því hvar lífeyrissjóðir geyma fé sitt en um það fjalla reglur um fjárfestingarheimildir þeirra. Eigendur eða sjóðfélagar eiga að geta treyst á að fá til baka það fé sem þeir eru skyldugir til að leggja í lífeyrissjóðina þegar tekjur þeirra minnka. Þeir verða að fá að treysta því að féð sé í öruggum höndum og að óþarft sé að hafa áhyggjur af stöðu sjóðsins á hverjum tíma. Margt bendir til þess að vafi leiki um skýrleika umræddra fjárfestingarheimilda, ekki síst hjá þeim sem best þekkja til.
    Höfundur setti fram rannsóknarspurninguna: „Hverjar eru fjárfestingarheimildir lífeyrissjóða – eru þær nægilega skýrar?“ Til að svara umræddri rannsóknarspurningu fór höfundur ítarlega í gegnum reglur um fjárfestingarheimildir lífeyrissjóðanna eins og þær eru í dag, þróun þeirra í gegnum árin og útgefið efni því tengt. Þá skoðaði höfundur löggjöf sem heimildirnar byggja á, fjármálaumhverfið á Íslandi og fjárfestingar svokallaðra þjóðarsjóða. Tilgangurinn með rannsókn þessari var að glöggva sig á þessum heimildum og skoða hvort allt væri með felldu en mikil umræða hefur átt sér stað um hlutverk og skyldur lífeyrissjóða fyrir þjóðina. Miklar breytingar hafa átt sér stað í fjármálaheiminum frá því lög um skyldutryggingu lífeyrisréttinda og starfsemi lífeyrissjóða, nr. 129/1997, tóku gildi þann 1. júlí 1998 og þótti höfundi forvitnilegt að kanna hvort fjárfestingarheimildirnar haldist enn í hendur við laga- og fjármálaumhverfi eins og það hefur þróast.
    Helstu niðurstöður eru þær að fjárfestingarheimildirnar eru orðnar flóknar og óskýrar og að tími er kominn á heildarendurskoðun þeirra. Í því sambandi er mikilvægt að hafa skýrleika ofarlega í huga sem og megintilgang þess að byggja upp og viðhalda öflugu lífeyriskerfi. Jafnframt bæri að líta til stærðar og einkenna lífeyrissjóða sem stórra fjárfesta á innlendum fjármálamarkaði. Í því skyni er nauðsynlegt að líta frekar út fyrir landssteinana varðandi fjárfestingar og taka tillit til breytts fjármála- og lagaumhverfis.

    Investment Regulation of Pension Funds
    Pension funds are both very large investors in the Icelandic financial market and even in international comparison. They have immense obligations towards their owners and to the society as a whole. It is therefore essential that all rules of their investments are very clear and consistent with the purpose of the pension system. There is no scope for uncertainty in these matters, especially regarding where the pension funds keep their assets, a topic which is covered in their investment regulation. Owners or members should be able to trust that that the money, they are required to contribute to the pension funds, will be returned when their income is reduced. They must be able to rely on the money being in safe hands and should not have to worry about how the money is being invested at a given time. There seems to be doubt about the clarity of the investment regulation, not least amongst those who are most familiar with the topic.
    The author put forward the research question: “What is the investment regulation of pension funds – is it sufficiently clear?” In order to answer the research question the author studied the current rules of investment regulation thoroughly, the evolution over the years and related publications. Then the author reviewed the legislation, which the regulation is based on, as well as the financial environment in Iceland and investments of the so-called sovereign wealth funds. The purpose of this study was to clarify how different sources cover the issue and see if it is in order, since there has been wide discussion on the role and obligations of the pension funds for the nation. Vast changes have taken place in the financial world since the Pension Fund Act, no. 129/1997, went into effect on July 1st of 1998 and the author found it interesting to look into whether the investment regulation still remains hand to hand with legal and financial environment as it has evolved.
    The main conclusions are that the investment regulation of pension funds has become complex and unclear and that it is time to review them wholly. In this context it will be essential for the regulation to be clear and precise, and to be true to the main purpose of establishing and maintaining a strong pension system. It would also be important to consider the size and characteristics of pension funds as investors in the domestic market. Then it becomes necessary to look outside the country regarding investments and take into account the changed financial and legal environment.
