  • Ritgerð þessi fjallar um stjórnkerfi fiskveiða og helstu stjórnskipulegu álitaefni sem risið hafa í tengslum við það. Slík álitaefni hafa aðallega risið á grundvelli eignarréttarákvæði 72. gr., atvinnufrelsisákvæði 75. gr. og jafnræðisreglu 65. gr. stjórnarskrár lýðveldisins Íslands nr. 33/1944. Þá verða framangreind álitaefni sett í samhengi við bæði nýlegar breytingar á stjórnkerfi fiskveiða með álagningu veiðigjalds sem og fyrirhugaðar breytingar á stjórnkerfi fiskveiða þannig að samningaleiðin, sem felur í sér að samið verði um úthlutun aflaheimilda til ákveðins tíma, taki við af varanlega úthlutuðum aflaheimildum sem núverandi stjórnkerfi fiskveiða byggist á. Í upphafi ritgerðarinnar verður fjallað um þær grundvallarreglur sem stjórnskipun Íslands byggir á og hvernig þær reglur endurspeglast í stjórnarskránni. Þá verður einnig fjallað sérstaklega um framangreind stjórnarskrárákvæði sem helstu álitaefni í tenglum við stjórn fiskveiða hafa risið á og gerð verður grein fyrir því á hverju þessi álitaefni byggja. Því næst verður fjallað sögulega um stjórnkerfi fiskveiða, það er að segja tilurð þess og hvernig kerfið hefur þróast og orðið að því kerfi sem notast er við í dag. Þar á eftir verður fjallað um þau stjórnskipulegu álitefni sem risið hafa á grundvelli eignarréttarákvæðis stjórnarkrárinnar, það er að segja hvort aflaheimildir njóti verndar þess. Þar næst verður svo fjallað um þau stjórnskipulegu álitaefni sem risið hafa á grundvelli atvinnufrelsisákvæðis og jafnræðisreglu stjórnarskrárinnar en dómstólar hafa þegar skorið úr um þau álitaefni í dómum sínum í Veiðileyfamálinu og Vatneyrarmálinu og verður því gerð grein fyrir niðurstöðum í þeim málum. Því næst verður svo fjallað um nýlegar og fyrirhugaðar breytingar á stjórnkerfi fiskveiða sem að framan eru greindar og þau stjórnskipulegu álitefni sem kunna að rísa á grundvelli 72. gr., 75. gr., og 65. gr. stjórnarskrárinnar í tenglum við breytingarnar. Að lokum verður svo lagt mat á það hvort hinar nýlegu og fyrirhuguðu breytingarnar á stjórnkerfi fiskveiða brjóti gegn 72. gr., 75. gr. og 65. gr. stjórnarskrárinnar.

    This paper discusses Icelandic fisheries management and the main constitutional issues that have arisen in relation thereto. Such issues have mainly arisen on the basis of the property right provisions of Article 72, the freedom of employment provisions of Article 75 and the principle of equality contained in Article 65 of the Constitution of the Republic of Iceland. Moreover, the above issues will be placed in context with both the recent changes to the fisheries management system with the imposition of the fishing fee as well as the planned changes to the fisheries management system so that the negotiations option, involving negotiations as to the allocation of catch quotas for a specific period, will replace the system of the permanently allocated catch quotas on which the present system is based. The paper begins with a discussion of the principles on which Icelandic constitutional law is based and the manner in which such principles are reflected in the Constitution. The above constitutional provisions on which the main issues in connection with fisheries management have arisen will be discussed specifically and an explanation given as to what these uncertainties are based on. Next the history of fisheries management will be discussed, i.e. its origins and the manner in which the system has developed and become the system used at the present time. Then there will be a discussion on the constitutional issues that have arisen on the basis of the property rights provisions of the Constitution, i.e. whether catch quotas enjoy the protection of the property rights provisions of the Constitution. Thereafter will be a discussion of the constitutional issues that have arisen on the basis of the Constitution’s provisions on the freedom of employment and the principle of equality. The courts have already issued their judgement on these issues in their rulings in the Veiðileyfamálið (the Fishing Licence Case) and the Vatneyrarmálið (the Vatneyrar Case). The conclusions of these cases will be discussed. Then an examination will be made of the recent and planned changes to the fisheries management system as described earlier and the constitutional issues that may arise on the basis of Articles 72, 75 and 65 of the Constitution in connection with the changes. Finally, an assessment will made of whether the recent and planned changes to the fisheries management system violate the provisions of Articles 72, 75 and 65 of the Constitution.
