  • Ritgerð þessi er rituð með það að markmiði að greina helstu siðfræðilegu álitaefni sem tengjast sjálfræði barna í heilbrigðisþjónustu og þátttöku þeirra í ákvörðunum. Samkvæmt lögum er varða börn og Barnasáttmála Sameinuðu þjóðanna á að tryggja börnum stigvaxandi þátttöku í ákvörðunum er þau varðar. Það þýðir að eftir því sem aldur og þroski segir til um skal tryggja að barn fái upplýsingar við hæfi og gefa því tækifæri til að taka þátt í samráði um ákvarðanir er varða það. Fyrir bæði foreldra og heilbrigðisstarfsfólk getur verið erfitt að takast á við stigvaxandi sjálfræði því það er matskennt og fer eftir einstaklingnum og eftir aðstæðunum. Flestum er tamara að hugsa um sjálfræði sem annað hvort eða, annað hvort sé fólk sjálfráða eða ekki. Í heilbrigðiskerfinu ætti samráð alltaf að vera við foreldra eða forráðamenn. Því má álykta sem svo að aðstæðubundið sjálfræði séð með augum feminista henti vel til að greina aðstæður í heilbrigðiskerfinu og mjög vel þegar átt er við börn og sjálfræði þeirra. Aðstæðubundið sjálfræði leggur áherslu á að manneskjan er háð öðrum, hún tekur ákvarðanir út frá öðrum, tekur tillit til annarra, ákvarðanir hennar hafa áhrif á líf þeirra sem hún er í tengslum við. Manneskjan er í félagsfræðilegu og sögulegu sambandi við aðrar manneskjur sem bæði verða fyrir áhrifum og hafa áhrif á hvernig líf hennar verður. Margar rannsóknir hafa verið gerðar erlendis á síðustu árum á þátttöku barna í ákvarðanatöku í heilbrigðisþjónustu. Hér voru skoðaðar nokkrar vel valdar rannsóknir og niðurstöður þeirra greindar út frá þremur sjónarhornum, sjónarhorni barns, sjónarhorni foreldris og sjónarhorni heilbrigðisstarfsmanna. Saman mynda þessir þrír aðilar einskonar samskiptaþríhyrning sem er þungamiðjan í allri umræðu og niðurstöðum. Niðurstaða greiningar á rannsóknunum er að samskipti sem byggjast á forræði heilbrigðisstarfsfólks eru líklega enn í dag algengasta samskiptaformið á milli heilbrigðisstétta og skjólstæðinga hennar. Ekki síst þegar um börn er að ræða. Líklegasta orsök þessa er hraði og tímaskortur sem einkennir heilbrigðiskerfið frekar en viljaleysi starfsmanna að samráð skuli ekki notað í meira mæli. Börn vilja samráð við foreldra sína og heilbrigðisstarfsfólk. Virk þátttaka barna hefur mjög jákvæð áhrif á líðan þeirra, hvort sem um er að ræða andlega líðan eða líkamlega og virðist vera mjög til góðs til lengri tíma litið, sér í lagi ef um var að ræða langvinna sjúkdóma sem barnið á eftir að lifa með alla ævi. Börn upplifa þátttöku mjög jákvætt, þau upplifa að vera metin að verðleikum, finnst þau meira virði og líður betur, þau upplifa að á þau sé hlustað og þeim sýnd virðing sem aftur ýtir undir og styrkir sjálfsmynd þeirra. Allt þetta eykur velferð þeirra og meðferðarheldni verður betri. Þá kemur í ljós að heilbrigðisstarfsfólk þarfnast betri leiðbeininga til að meta hæfni barna. Það hefur tilhneigingu til að meta skjólstæðing sinn sjálfráða eða ekki, en það vefst fyrir þeim að börn eru stundum meira og stundum minna sjálfráða. Sem er óáþreifanlegt og vekur óöryggi þeirra. Í niðurstöðum má draga fram þrjú siðfræðileg álitaefni sem tengjast þátttöku barna í ákvörðunum varðandi eigin meðferð: 1. Sjálfræði barna er mismikið – stundum mikið og stundum lítið, það fer eftir aðstæðum. 2. Sjálfræði barna er stigvaxandi. 3. Hæfni barna er gjarnan vanmetin en sjaldan ofmetin. Þessi þrjú álitaefni kalla á breytta sýn á sjálfræði barna í heilbrigðisþjónustu, meira samráð og fjölskyldumiðaða nálgun sem gefur tækifæri til að réttur barna til stigvaxandi sjálfræðis sé virt. Fjölskyldumiðuð nálgun virðist nálgast á einstakan máta þátttöku barns og fjölskyldu þess í afar erfiðum ákvörðunum. Það er ljóst á niðurstöðum rannsókna sem hér hefur verið fjallað um að börn taka of lítinn þátt í ákvörðunum. Þá niðurstöðu er hægt að taka áfram og leggja til að á heilbrigðisstofnunum verði gerð bragarbót á með því að fara í stefnumótandi vinnu að úrbótum. Sú vinna myndi meðal annars kalla á tillögur um það hvernig meta eigi hæfni barna og hvernig gefa skuli börnum meiri tíma til að leyfa þeim að taka þátt.

    The Objective of this study is to determine what are the ethical issues related to the autonomy of children in health care and their participation in decision-making. Icelandic laws and the UN Convention on the Rights of the Child ensure the rights of children to gradual participation in decisions concerning them. That means that with growing age and maturity a child shall receive appropriate information and be given the opportunity to participate in the consultation on decisions relating to it. For both parents and health care worker dealing with progressive autonomy can be difficult because it is based on subjective judgement and depends on the individual and on the situation. It is more common to think about autonomy as either or, either people are autonomous or not. In the health care system consultation with parents or guardians should be the norm. It can be concluded that that the Feminist approach on relational autonomy is ideal for certain situations in the health care when dealing with children and their autonomy. Decisions are subject to local conditions and social relations. The person is dependent on others, she takes decisions based on others, taking into account the opinion of others, her decision affects the lives of those around her. The person is in a social and historical relationship with other people that are both exposed to her and have an impact on how her life will be. Numerous studies have been carried out in recent years on children's participation in the decision-making process concerning their health issues. In this study several carefully selected studies and their results are being analysed from three perspectives, the perspective of the child, the parent's perspective and the perspective of health care worker. Together these three perspective form a kind of communication triangle that is the focal point of discussion and results. The results of this study indicate that some form of paternalism is probably still the most common form of communication between health care professionals and their client. Especially when children are involved. The speed and lack of time that often characterizes the activities of health care workers is most likely the main reason for lack of consultation with clients. Children want to consult with their parents and health care professionals. Active participation of children tends to have a positive impact on their mental and physical wellbeing. Participation tends to be very beneficial in the long run, especially those children with chronic lifetime diseases. Children experience participation in a very positive way, they feel appreciated, they feel more valuable and feel better, they feel that they are listened to and respected, which in turn encourages and strengthens their identity. This increases their welfare and the compliance to the treatment will be better. The study also revealed that health care workers need better guidelines to assess the competence of children. They tend to evaluate their clients as autonomous or not, it can be complicated that children are sometimes more and sometimes less autonomous. It is intangible and raises their insecurity. The results of the study highlight three ethical issues related to children's participation in decisions regarding their treatment: 1. Autonomy of children varies - it is sometimes more and sometimes less, depending on the circumstances. 2. Autonomy of children is considered gradual. 3. The ability of children is often underestimated but rarely overestimated. These three perspectives call for a new vision for the autonomy of children within the health care system. More consultation and a family-centred approach is needed so that the right to a progressive autonomy of children is adhered to. The family-centred approach introduced seems to be a unique approach to increase the participation of the child and the family in decision making process. The results of the studies discussed indicate that children do not participate enough in the decision making process. The health care system needs to take steps to improve the consultation process. This calls for suggestions on how to evaluate the competence of children and how children should be given more time to participate.
