    Meginmarkmið ritgerðarinnar er að leiða í ljós þá skyldu sem hvílir á
    fasteignasala að skoða fasteign sem hann hefur til sölumeðferðar og lýsa ástandi fasteignar og göllum sem hann sér við þá skoðun í söluyfirliti. Í upphafi ritgerðarinnar verður fjallað um réttarstöðu löggiltra fasteignasala, skaðabótaábyrgð þeirra og þær reglur um sérfræðiábyrgð sem þeir lúta. Þá verður fjallað stuttlega um helstu skyldur fasteignasala samkvæmt II. kafla laga nr. 99/2004 um sölu fasteigna, fyrirtækja og skipa. Gerð verður nánari grein fyrir þeirri skyldu fasteignasala að útbúa söluyfirlit um fasteign sem hann hefur milligöngu um að selja, sbr. 10.-12. gr. laganna. Því næst verður farið ítarlega yfir skoðunarskyldu fasteignasala á fasteign sem hann hefur til sölumeðferðar, sbr. 2. ml. 1. mgr. 12. gr. laganna.
    Eftir dóm Hæstaréttar frá 21. nóvember 2002 í máli nr. 223/2002 og gildistöku laga nr. 99/2004, hafa fallið dómar þar sem fasteignasalar eru dæmdir skaðabótaskyldir vegna galla í fasteignum sem þeir hafa ekki tilgreint í söluyfirliti fasteignar. Höfundur leitast við að svara því hversu ríkar kröfur séu gerðar til skoðunarskyldu fasteignasala. Hvort að fasteignasalar hafa borið skaðabótaábyrgð vegna augljósra galla og einnig hvort að þeir hafa borið skaðabótaábyrgð vegna leyndra galla á fasteignum. Einnig leitar höfundur svara við því hvort að upplýsingaskylda seljanda eða aðgæsluskylda kaupanda, takmarki skoðunarskyldu fasteignasala að einhverju leyti. Þá verður litið til norræns réttar og skoðað hvort að reglur íslensks réttar, um skoðunarskyldu fasteignasala séu sambærilegar og í Danmörku, Noregi og Svíþjóð.
    Niðurstöður ritgerðarinnar eru í stuttu máli að ríkar kröfur eru gerðar til skoðunarskyldu fasteignasala í íslenskum rétti. Fallið hafa dómar þar sem fasteignasalar bera skaðabótaábyrgð á leyndum göllum á fasteignum. Fasteignasali ber venjulega ekki skaðabótaábyrgð á augljósum göllum þar sem aðgæsluskylda kaupanda er rík. Skyldur fasteignasala skv. II kafla laga nr. 99/2004 eru óháðar upplýsingaskyldu seljanda. Fasteignasala ber að rækja upplýsinga- og skoðunarskyldu sína sjálfstætt og staðreyna upplýsingar sem hann fær frá seljanda með sjálfstæðri skoðun. Þá eru reglur íslensk réttar varðandi skoðunar- og upplýsingaskyldu fasteignasala ítarlegri og víðtækari en á öðrum Norðurlöndum.

    Realtors' inspection
    The purpose of this bachelor's thesis is to reveal the obligations that the real estate agent has to inspect the property which he has listed for sale. The Author will detail the agents responsibility to disclose and list, in his sales statement, any known defects, conditions or problems associated with the subject property.
    At the beginning of the thesis the legal status of licensed real estate agents are discussed, and in addition, the professional responsibility and liabilities of which they are subject to. It will then briefly go over the main responsibilities of Realtors, according to provisions of the second chapter of law, regarding the sale of real estate, businesses and ships, no. 99/2004. Seeking further clarification, the Author defines in more detail the realtors' duty to prepare a sales statement regarding the property, which he has arranged to sell, where he is an intermediary, in accordance with cf. Articles 10.-12. of the aforementioned law. Thereafter the real estate agents' duty to perform an inspection of the property listed for sale, cf. paragraph 1 in Article 12 of the previously referenced law.
    As a result of the decision of the Supreme Court of Iceland from November 21st, 2002, in case 223/2003, as well as the aforementioned Act no. 99/2004 being inacted, other court judgments have gone on to find the real estate agent liable, due to defects of a property, that had not been specified in the sales statement. The Author will seek to answer how strict the demands are for a Realtor to scrutinize a property and whether Realtors have been found liable for obvious defects in a property or if they have been liable for hidden defects. Furthermore the determination as to whether or not the sellers' obligation to disclose relevant information and the buyers duty to make a careful inspection of the property, can to some extent, mitigate the Realtors' obligation to disclose. Then the impact of Nordic Law and the question of whether the aforementioned observation of duty in the Icelandic Law is comparable to those in Denmark, Norway and Sweden.
    It was the finding of this thesis that strict observation requirements on real estate agents are based in Icelandic Law. Court judgments have stated that Realtors' are liable for hidden defects in the subject property. They are on the other hand usually not found liable for obvious defects since the buyers duty to inspect the property is strictly adhered to. Realtors' obligations, according to the second chapter of law no. 99/2004, are independent of the sellers' duty to disclose. The Realtor must therefore verify the information received from the seller. It was then also found that the rules of Icelandic Law regarding Realtors' inspection and disclosure obligations are much more details and encompassing that in the other Nordic countries.
