  • Tilgangur þessarar ritgerðar er að rannsaka og gera skipulega grein fyrir stjórnskipulegri vernd aflaheimilda á Íslandi og í Noregi. Ástæðan fyrir því að fjalla um og bera saman gildandi regluverk þessara tveggja landa byggir á þeirri staðreynd að hér er um að ræða tvö lönd sem eiga bæði langa útgerðarsögu og hefur útgerðarrekstur talist til grundvallaratvinnuvegar í þeim báðum þrátt fyrir miklar breytingar á efnahagslífi þessara þjóða á undanförnum árum.
    Í ritgerðinni er gerð grein fyrir þeim reglum sem gilda um stjórnskipulega vernd aflaheimilda á Íslandi og í Noregi. Í upphafi er fjallað með almennum hætti um grundvallarskipulag fiskveiðikerfa Íslands og Noregs en að því loknu er stjórnskipuleg vernd aflahlutdeildar, sem telst til grundvallarhugtaka í fiskveiðikerfum beggja þjóða, tekin til nánari skoðunar. Við lýsingu á eðli og inntaki þeirrar stjórnskipulegu verndar er tekið mið af hefðbundnum réttarheimildum, s.s. lögum (stjórnskipunarlögum og almennum lögum), dómafordæmum og kenningum fræðimanna. Þá er ennfremur, einkum í umfjöllun um einstök dómafordæmi þar sem það á við, gerð grein fyrir áhrifum Mannréttindasáttmála Evrópu á forsendur dóma á Íslandi og í Noregi. Að síðustu er fjallað um nokkur norsk dómafordæmi sem eru lýsandi fyrir það hversu flókin vandamál geta leitt til mismunandi niðurstöðu þrátt fyrir að falla undir sömu réttarheimildirnar.

    The purpose of this bachelor thesis is to research and describe the constitutional protection of quota in Iceland and Norway. The reason for discussing and comparing the regulatory regimes currently in force in these two countries is based upon the fact that these two countries have a long history of commercial fishing and fishing operations have been considered fundamental pillars in the economies of both countries despite considerable changes in recent years.
    The thesis describes the laws and regulations applied with regard to the constitutional protection of quota in Iceland and Norway. It starts with a general discussion regarding the fundamental principles applicable to the fisheries management systems of Iceland and Norway and is followed with a description of the constitutional protection - a notion that is fundamental to the fisheries management systems of both countries. The thesis looks to conventional sources of law when describing the nature of the constitutional protection to which quota is subjected, namely laws (constitutional law and general acts of law from parliament), court precedents and writings of distinguished scholars. In addition, in particular when discussing various court judgments, the thesis discusses the way in which the European Convention on Human Rights has influenced arguments made in various Icelandic and Norwegian court judgments. Finally, the thesis focuses on a number of Norwegian court judgments that are descriptive of how complex legal problems can lead to different conclusions despite being subjected to the same sources of law.
