Ritgerðin fjallar um málskotsrétt forseta samkvæmt 26. gr. stjórnarskrár lýðveldisins Íslands en í ákvæðinu felst vald forseta til þess að neita að skrifa undir lagafrumvarp sem Alþingi hefur samþykkt og sker þá þjóðaratkvæðagreiðsla úr um gildi laganna. Ákvæðið er umdeilt og hefur lögfræðinga og aðra greint á um hvernig beri að túlka það. Ástæðurnar eru hversu opið orðalag ákvæðisins er og hvaða hugmyndir búa að baki því. Beiting, eða kannski skortur á beitingu, ákvæðisins fram til ársins 2004 varð til þess að fræðimenn drógu vald forseta í efa en nú er ljóst, eftir að forseti hefur synjað lögum undirskriftar í tvígang án afskipta annarra handhafa ríkisvaldsins, að forsetinn hefur þetta vald.
Í ritgerðinni er fjallað er um stjórnskipulega stöðu forseta Íslands út frá nefndri 26. gr. stjskr. og hvort Alþingi hafi heimild til að nema úr gildi lög sem forseti hefur synjað staðfestingar. Slík afturköllun laga hefur í för með sér að ekki fer fram þjóðaratkvæðagreiðsla. Niðurstaðan er sú að Alþingi hefur heimild til þess að nema úr gildi lög sem forseti hefur synjað staðfestingar, þrátt fyrir að veigamikil rök mæli gegn því, eins og skýrt orðlag 26. gr. stjskr., enda er löggjafarvaldið ótvírætt hjá Alþingi og þar með valdið til þess að nema lög úr gildi.
Fjallað er um sambærileg ákvæði í stjórnarskrám annarra ríkja en þó sérstaklega í völdum nágrannalöndum enda er almennt litið til þeirra þegar kemur að lagasetningu. Ljóst er að einhvers konar temprun á löggjafarvaldi Alþingis er nauðsynleg enda almennt gengið út frá því að aukin valddreifing sé til hins betra og leiði til stöðugra stjórnarfars. Teknar eru sérstaklega til skoðunar þrjár mögulegar leiðir við breytingu á ákvæðinu með markmið ákvæðisins í huga. Í fyrsta lagi er fjallað um nýja skipan mála varðandi þjóðaratkvæðagreiðslur, svokallaðan frumkvæðisrétt þjóðar en í því felst réttur þjóðarinnar til að kalla eftir þjóðaratkvæðagreiðslu í tilteknum málum. Í öðru lagi er fjallað um stjórnarskráreftirlit, það er eftirlit með því að lög séu í samræmi við stjórnarskrá. Í þriðja og síðasta lagi er fjallað um þá leið að forseta sé heimilt að senda frumvarp aftur til þingsins en þingið geti þá yfirunnið frumvarpið með samþykki 2/3 hluta þingmanna og héldi það þá gildi sínu.
This thesis discusses the powers of the president of Iceland under Article 26 of Iceland’s Constitution to submit before a national referendum a bill, passed by Althingi, by refusing to sign such a bill. The outcome of the national referendum decides on whether the approved is upheld bill or ceases to have effect as law. The abovementioned Article is controversial and lawyers as well as scholars have argued on how to construe the said Article. The reasons for the controversy are that the Article is open to construction and the political ideology behind the Article. The use or maybe lack of use, of the presidents’ powers according to Article 26 of the Constitution, until the year 2004 led certain scholars to doubt the presidents’ powers. Now, after the president has on two occasions exercised his powers under the constitution, without the intervention of other branches or the government, it is clear that the president is granted the abovementioned powers by the constitution.
The thesis discusses the constitutional standing of the president of Iceland under Article 26 of the Icelandic Constitution and whether Althingi has the authority to revoke law which the president has refused to sign, and therefore not confirming the law. Such a revocation has the effect that there will be no referendum. It is the conclusion of this thesis that Althingi has the authority to revoke such a law which the president has refused to sign, even though the wording of Article 26 is clear, the legislative powers rest with Althingi and therefore it can revoke any law it has previously passed.
The thesis covers comparable Articles in the constitutions of other countries, mainly in Scandinavia as it is traditional in Iceland to look to its neighbouring countries for guidance when legislating. It is obvious that some type of moderation for the powers of the legislative branch is necessary on the basis of that decentralisation of governmental powers is good in general and leads to a stabilized government. The thesis discusses three alternative routes should Article 26 of the Icelandic Constitution be changed given the objective of the mentioned Article. First, it is discussed that the nation may be given a proactive right to call for a national referendum. Secondly, constitutional supervision is discussed. That is the supervision by a government branch whether law is in conformity with the Constitution. Thirdly, the possibility of the president sending the approved bill back to the Althingi which would then have to pass it by 2/3 of its members for the law to stay in effect.
