  • Tilgangur þessarar ritgerðar er að varpa ljósi á hvert lagaumhverfi sjálfstæðrar þjóðkirkju Íslands væri ef ríki og kirkja yrðu aðskilin. Þjóðkirkja Íslands er stjórnarskrárvarin samanber 62. gr. stjórnarskrár Íslands og ber ríkisvaldinu að því leyti að vernda hana og styðja. Með ákvæði þessu nýtur þjóðkirkjan sérstöðu umfram önnur skráð trúfélög í landinu. Þjóðkirkjufyrirkomulagið er ekki talið fela í sér brot á stjórnarskrá né Mannréttindasáttmála Evrópu, en dómur hefur fallið í Hæstarétti Íslands því til stuðnings. Árið 1997 tóku gildi ný þjóðkirkjulög og með þeim lögum öðlaðist þjóðkirkjan meira sjálfstæði en áður var þekkt. Helstu niðurstöður eru eftirfarandi. Möguleikarnir í aðskilnaði ríkis og kirkju eru í raun og veru tveir, að aðskilja að hluta til eða að öllu leyti. Á Íslandi hefur kristin trú verið ríkjandi frá árinu 1000 og þar af leiðandi haft áhrif á menningu landsins og sögu. Því þykir raunhæfari leið í dag að aðskilja ríki og kirkju að hluta til. Í slíkum aðskilnaði felst, að fella þarf á brott stjórnarskrárvarinn rétt þjóðkirkjunnar, gera þyrfti upp samninginn milli ríkisins og kirkjunnar sem gerður var árið 1997, um að ríkið sé eigandi kirkjujarða en greiðir ákveðnum embættismönnum kirkjunnar laun í staðinn. Af því leiðir að upptaldir starfsmenn kirkjunnar teldust ekki til embættismanna og starfsmanna ríkisins og nytu þar af leiðandi ekki verndar laga nr. 70/1996. Verkefni dómsog mannréttindaráðuneytisins myndu að sama skapi verða algjörlega á valdi kirkjunnar. Önnur tengsl gætu haldið sér, þjóðkirkjan gæti haldið starfi sínu áfram en myndi lúta sömu lögum og önnur skráð trúfélög á Íslandi.

    The purpose of this essay is to clarify what will be the legal environment of the independent church of Iceland if the state and the church were separated. The IIelandic church is protected of articel 62 in the Icelandic Constitution and Icelandic church is in an unique position above other registered sects in the country. The Supreme Court has ruled a judgement which says that the Icelandic Church organisation does not infringe the Constitution nor the Europeean Court of Human Rights. In the year 1997 new legislation concerning the Icelandic Church came into effect and according to this legislation the Icelandic Church attained more independence than previously knowned. The main conclusion is as follows. The possibilities of separating the church from the state are actually two, to separate partly or fully. In Iceland Christianity has been prevailing from the year one thousand and consequently has effected the nation´s culture and history. Therefore it must be considered more realistic to separate the church partly from the state. Such a separation consists in abolishing the Icelandic church constitutional protected rights. The agreement between the church and the state from the year 1997 would be receded where it is stated the state is the owner of church landproperties and instead the state is obliged to pay the public officers salaries. Consequently the employees of the church woukld no longer be public officers and would therefore not enjoy the protection by the law no 70/1996. Assignments by the Justice and Human rights ministry would at the same time be totally in the power of the church. Other relations would be unchanged, the churh could carry on it´s responsibilities but would obay the same law as every other registered sect in Iceland.
