    Í störfum sínum er barnaverndaryfirvöldum skylt að beita ráðstöfunum með hagsmuni barnsins að leiðarljósi. Við beitingu úrræða barnaverndarlaganna þurfa barnaverndaryfirvöld að fylgja meðalhófsreglu stjórnsýslulaga nr. 37/1993 og barnaverndarlaga nr. 80/2002, en samkvæmt reglunni er óheimilt að ganga lengra í beitingu þvingunarúrræða en nauðsyn ber til að ná því markmiði sem að er stefnt. Þegar barnaverndaryfirvöld þurfa að hafa afskipti af börnum og vista þau utan heimilis eða krefjast forsjársviptingar er mikilvægt að hagsmunir barnsins gangi framar hagsmunum hinna fullorðnu.
    Ritgerð þessi fjallar um samspil meðalhófsreglunnar og meginreglunnar um hagsmuni barnsins við framkvæmd barnaverndarlaga. Til að varpa ljósi á hvernig þessar tvær reglur virka í framkvæmd, þegar börn eru vistuð tímabundið utan heimilis eða krafist er forsjársviptingar, voru skoðaðir dómar Hæstaréttar, héraðsdómar frá Héraðsdómi Reykjavíkur, úrskurðir kærunefndar barnaverndarmála og úrskurðir barnaverndarnefndar Reykjavíkur.
    Markmið ritgerðarinnar er m.a. að svara spurningum um hvort meðalhófsreglan og meginreglan um hagsmuni barnsins vinni e.t.v. gegn hvor annarri? Ef farið er eftir meðalhófsreglunni og ætíð reynd vægari úrræði áður en barn er vistað utan heimilis, kemur það í einhverjum tilvikum niður á hagsmunum barnsins? Hvor reglan vegur þyngra við úrlausnir mála fyrir dómstólum og hjá barnaverndaryfirvöldum? Eru hagsmunir hinna fullorðnu jafnvel teknir fram yfir hagsmuni barnsins í einhverjum tilvikum?
    Barnaverndaryfirvöld reyna ávallt að leita eftir samþykki foreldra og beita stuðningsúrræðum áður en þvingunarúrræðum er beitt. Dómstólar líta til þess hvort meðalhófsreglunni hafi verið fylgt áður en þeir fallast á kröfu um vistun barns utan heimilis eða kröfu um forsjársviptingu. Dómstólar hafa í sumum tilvikum látið hagsmuni barnsins ganga framar meðalhófsreglunni og samþykkt kröfu barnaverndaryfirvalda án þess að búið sé að reyna til hlítar stuðningsúrræði inni á heimili barns. Dómstólar rökstyðja niðurstöðu sína í slíkum tilvikum með vísan til hagsmuna barnsins.

  • The interaction of the proportionality principle and the principle of the child's interests in the implementation of the Child Protection Act nr. 80/2002
    In their work, child protection authorities are obliged to take measures with the best interests of the child in mind. In applying their resources, according to the child protection act, child protection authorities are required to follow the principle of proportionality. The aim shall be to apply the minimum measures to achieve the desired results. When child protection authorities need to intervene with families and remove children from the home it is important that the interest of the child take precedence over the interest of the adults.
    This thesis examines the interplay of the principle of proportionality and the principle of the child's best interests in implementing the Child Protection Act. To shed light on how these two rules work in practice the author examined judgments of the Supreme Court, Reykjavík District Court, rulings and decisions of the Child Protection Appeals Board and the rulings of the Child protection committee in Reykjavik.
    The aim of the thesis is, i.a. to answer questions about whether the proportionality principle and the principle of the interests of the child's may work against each other? Which principle takes priority when judges are solving cases concerning child protection? Are the interests of the adults perhaps given priority before the interests of the child in some cases?
    Child protection authorities always try to seek parental consent and use of support measures before compulsion or force is imposed. The Courts consider whether the principle of proportionality has been complied with before they accept the claim from child protection authorities for placement of a child in foster care or a claim for deprivation of custody. Courts have in some cases accepted that the interest of the child should take precedence over the principle of proportionality and accepted child protection authorities' claims even though the authorities have not tried lesser measures for improvement, on the basis that it best serves the interest of the child.
