  • Þessi ritgerð fjallar um svonefndan stjórnunarrétt vinnuveitanda og stöðu hans í málum sem varða opinberar stöðuveitingar. Samkvæmt stjórnunarréttinum getur vinnuveitandi ákveðið hvaða matsforsendur hann styðst við þegar hann ræður fólk til starfa.
    Kjarni málsins er sá að nokkurs misræmis í beitingu stjórnunarréttar virðist gæta í niðurstöðum, annars vegar hjá Kærunefnd jafnréttismála, sem fer með úrskurðar-vald í slíkum málum, og hins vegar hjá Hæstarétti, þar sem fallið hafa nokkrir dómar í kjölfar þess að málsaðilar hafa verið ósáttir eftir úrskurð kærunefndar og farið með málið fyrir dómstóla.
    Leitast verður við að svara því hvernig kærunefnd, eða eftir atvikum Hæstiréttur, beitir meginreglu vinnuréttar um stjórnunarrétt. Opinberar stöðuveitingar eru, eins og dæmin sanna, vandmeðfarnar, valda oft deilum og jafnvel kærum til Kærunefndar jafnréttismála. Svo kann að vera að reglunni um stjórnunarrétt sé gefið of mikið vægi en ekki liggur fyrir hvor aðilinn það er sem notar hann meira.
    Höfundur kemst meðal annars að þeirri niðurstöðu að í máli nr. 3/2010, sem varðaði skipan í stöðu skrifstofustjóra hjá forsætisráðuneytinu, kunni það að vera svo að kærunefndin sé komin aftur á þann stað sem hún var á í máli nr. UA 2240/1997 (Fjölbrautarskólamálinu). Málin eru sambærileg á þann hátt að þegar kærunefndin leggur til grundvallar nýjan hæfnisþátt og byggir úrskurð sinn á honum er nefndin í rauninni komin út fyrir verksvið sitt og það er henni einfaldlega ekki heimilt að gera eins og umboðsmaður hefur bent á.

    This paper examines the so-called administrative privilege of employers and how it is executed in the granting of public post. According to the privilege, the employer can decide which criteria of assessment he uses when deciding who should be hired.
    The focus is on alleged discrepancies in the ruling of this privilage, on the one hand as manifested in the conclusions of the Complaints Committe, which is a part of the Icelandic equality system, and on the other hand in some verdicts of the Supreme Court in Iceland. The court is a part of the picture as some people, who have been parties in disputes about the granting of public offices, have refuted the conclusions of the Complaints Committe and taken legal action.
    The purpose of the paper is to shed some light on how either the Complaints Committe or the Supreme Court, as the case may be, executes the administrative privilege of employers which is a part of the legislation of labour. Experience shows that the granting of public posts is a sensitive matter which often leads to disagreement and formal complaints. Perhaps the administrative privilage has gained undue importance but it is not clear yet, however, whether it is the committee or the court which relies more on it.
    The analysis in the paper shows that in a certain case, nr. 3/2010, which had to do with the hiring of a top official in the Prime Minister's office, the Complaints Committe may have returned to a certain point of departure in the past when it dealt with case nr. UA2240/1997 (The College case). The two cases are comparable because in both instances the Complaints Committe established new assessment criteria which was not within its power to do, as the Althing Ombudsman in Iceland has pointed out.
