  • Aðalviðfangsefni ritgerðarinnar er að skoða áhrif ítrekunar á refsingar í fíkniefnamálum. Leitast er við skoða hina almennu ítrekunarheimild í 71. gr. almennra hegningarlaga nr. 19/1940 (hgl.) auk þess sem litið er til ítrekunarákvæða í sérrefsilögum. Almenna skilgreiningin á hugtakinu ítrekun í tengslum við afbrot er sú að ef einstaklingur hefur framið afbrot, skal það hafa ítrekunaráhrif sé lagaheimild til staðar að láta refsiákvörðun vegna fyrra afbrots hafa áhrif á aukningu refsingar í síðara broti sama einstaklings. Þarf hann að hafa verið dæmdur sekur um brot eða gengist undir refsingu hér á landi fyrir brot, sem hefur ítrekunaráhrif á síðara brotið. 71. gr. hgl. er ákvæði um ítrekun sem gildir án tillits til einstakra brotategunda. Ákvæðið felur ekki sjálft í sér ítrekunarheimildir, heldur tekur fram þau skilyrði sem ítrekunarheimildir í sérrefsilögum þurfa að uppfylla. Til afmörkunar var litið til fíkniefnalöggjafarinnar. Oftar en ekki eru það sömu aðilar sem fremja fíkniefnabrot og því getur komið til álita hvernig ítrekun hefur áhrif á refsingar í fíkniefnamálum. Leitast var við að skoða almenna fíkniefnalöggjöf hér á landi og litið til þess hvar mörkin liggja á milli laga um ávana- og fíkniefni nr. 65/1974 og ákvæðis 173. gr. a. hgl., þ.e. hvað þurfi til að fíkniefnabrot teljist stórfellt og falli undir ákvæði 173. gr. a. eða að það sé talið minniháttar og falli undir ávana- og fíkniefnalög. Ítrekunarheimildin í 8. mgr. 5. gr. ávana- og fíkniefnilaga er eina sérstaka refsihækkunarheimildin sem er að finna í fíkniefnalöggjöfinni. Í ákvæðinu er tiltekið að það nái til innflutnings og dreifingar. Þegar litið er til dómaframkvæmdar má sjá að ítrekunarheimildir koma til aukningar á refsingu, þó innan almennra refsimarka eða sérrefsimarka laganna (refsiramma). Er ýmist vísað til 71. gr. hgl., 8. mgr. 5. gr. ávana- og fíkniefnalaga, þeirra beggja eða jafnvel hvorugrar þó svo að fyrra brot einstaklings hafi ítrekunaráhrif í þeim dómi.

    The main subject of this essay is to examine how recidivism affects punishment in drug cases. The author seeks to examine the main article about recidivism in Article 71. of the Icelandic Penal Code no. 19/1940 and other articles about recidivism in special legislation.
    The main definition of the concept of recidivism is that it an offence has a repeated impact. If a person has committed an offense, it shall have the effect that the previous criminal offense increases the penalty for the second violation for the same person. Before the person committed the second offense he or she must have been previously convicted of a violation or undergoing punishment in Iceland for an offense that has repeated impact on the second offense. Article 71 of the Penal Code applies regardless of the individual offense type. The article does not in itself contain a source for recidivism, but notes specific conditions that articles in other legislations, that contain articles with recidivism sources, must fulfill.
    In order to confine, the author mainly examined the drug legislation in Iceland and how it has developed. More often it is the same persons who commits drug offenses, and therefore recidivism influences their sentences in drug cases. The author also seeks to examine the boundaries between the Addictive Drugs Act/Code no. 65/1974 (Laws respecting Dependence Producing Substances (euphoretics)) and Article 173. a. of the Icelandic Penal Code no. 19/1940.
    The 8th Paragraph of Article 5 in the Addictive Drugs Act/code no. 65/1974 is the only specific article that contains a source for recidivism and leads to an increased penalty. The provision includes both import and distribution of drugs. When looking to precedents it shows that the source for recidivism increases the penalty, though within the range of possible penalties. Usually the judge refers only to Article 71., only to the 8th Paragraph of Article 5, or the two of them together or even neither of them, even though a previous offense has the effect of recidivism.
