  • Á Íslandi er skólaskylda 10 ár og hefur verið það frá því að lög nr. 49/1991 um grunnskóla voru sett. Skólaskylda hefur verið að lengjast frá því að tilskipun um húsaga var sett árið 1746 en það voru fyrstu lögin sem sett voru um menntamál þjóðarinnar. Skólaskylda tryggir öllum börnum innan ákveðins aldurs rétt til skólagöngu, burt séð frá stöðu foreldra eða búsetu. Aukinni skólaskyldu fylgir að hluti uppeldis barna flyst yfir á skólastofnanir og vald foreldra til þess stjórna menntun barna sinna og uppeldi minnkar. Markmið þessarar ritgerðar er að skoða hvort foreldrar hafi raunverulega möguleika á að hafa áhrif á menntun og skólagöngu barna sinna í grunnskólum Íslands. Litið verður á helstu alþjóðlegu yfirlýsingar, samninga og sáttmála sem Ísland er aðili að og fjalla um efnið og farið í dóma Mannréttindadómstóls Evrópu. Síðan verður litið á löggjöf um grunnskóla, aðalnámskrá og reglugerðir er fjalla um efnið. Fín lína er á milli þess að skólinn hafi of mikið vald og þess að foreldrum sé falinn of stór hluti í ákvarðanatöku um menntun barna sinna. Tryggja þarf að börn njóti réttar til menntunar og er því ekki hægt að gefa foreldrum algjörlega lausan tauminn hvað varðar skólagöngu barna. Niðurstaðan er sú að þó svo að úrræði foreldra, til að hafa áhrif á menntun og skólagöngu barna sinna, séu ekki fullkomin þá eru ýmis góð raunveruleg úrræði sem þeir geta nýtt sér.
    Abstract:
    Since law nr. 49/1991 on primary education entered into force, a ten-year minimum compulsory education has been in effect for all children in Iceland. Compulsory education has been getting longer since the first decree on education was passed in 1746. Compulsory education ensures that every child in a certain age range enjoys the right to education, irrespective of his or her parents’ situation or his or her place of residence. Longer compulsory education means that a big part of a child’s upbringing is through the school system and the parental power to control what they study diminishes. Most parents want to have as big role as possible in sculpting and raising their children. The focus of this thesis is to see if parents have a real possibility to influence their children’s education and school attendance in Iceland’s primary schools. To that end, the thesis begins with a short analysis of pertinent international declarations and conventions to which Iceland is a party as well as an examination of some judgments from the European Court of Human Rights. An analysis will also be provided on the Icelandic law on primary schools as well as the national curriculum and regulations. There is a fine line between parents having too much power to control their children’s education and the schools having too much power. Children’s rights to education have to be ensured and because of that parents cannot be allowed to do what they want with their children’s education. The conclusion is that notwithstanding the limitations facing parents in terms of influencing their children’s education and school attendance, there are many good resources that give parents a reasonable power to influence the schools.
