  • Ritgerð þessi fjallar um réttindi langveikra ADHD barna er njóta samsettrar meðferðar. Í henni er m.ö.o. leitast við að svara því hvort skólar og stjórnvöld taki tillit til réttinda þeirra og þarfa í samræmi við gildandi lög, reglur og sáttmála. Álitaefnið er þrengt og skoðað með áherslu á börn er greinst hafa með sjúkdóminn ADHD og njóta samsettrar meðferðar að læknisráði. Við skoðum upplýsingaskyldu grunnskólanna að lögum til forráðamanna ADHD barns, þ.e. hvernig upplýsingum um það hvernig barninu reiði af innan skólans við daglegar athafnir sínar sé miðlað til foreldris, og hvort skólinn beiti sannanlega fyrirfram kynntum einstaklingsmiðuðum meðferðarúrræðum ef sjúkdómseinkenna verður vart hjá barninu í grunnskólanum. Við skoðum hvernig forsjárforeldri getur fylgt eftir kæruferlum vegna barns síns ef það telur sig ekki fá fullnægjandi upplýsingar um barnið frá skóla. Við skoðum hvernig skorið er úr ágreiningi um þessa hagsmuni ef upp kemur ágreiningur milli forsjármanna barnsins og skólans, og hvort að grunnskólinn setji hagsmuni barnsins framar sínum eigin. Við skoðum tímafrek kæruferlin og hugum að því hvort aðkoma æðri stjórnvalda gagnist viðkomandi barni þegar málshraði er ekki meiri en raun ber vitni. Við skoðum hvort það samræmist réttindum og bata fyrrnefnds ADHD grunnskólabarns ef stjórnvöld geta ákveðið einhliða að miðla upplýsingum um barnið til forsjárforeldris eingöngu með upplýsingaforritinu Mentor, og skoðum samhliða því almenna beina skyldu skólasamfélagsins til samskipta við forsjárforeldri er Mentor sleppir. Niðurstaða ritgerðarinnar er að enn skorti talsvert á að ADHD börnum og forsjármönnum þeirra séu tryggð þau réttindi er þau eiga að lögum. Kæruferlin eru of löng og koma viðkomandi barni sjaldnast að gagni. Því er nauðsynlegt að löggjafinn setji skýrari verklags- og vinnureglur svo að lögboðin réttindi langveikra ADHD barna séu raunverulega virt innan skólastofnana og að allt eftirlit með einstaklingsmiðuðum hagsmunum barnanna verði stóreflt, ekki síst innan grunnskólanna.

    Are the rights of ADHD children really respected within the school system?
    This thesis discusses the rights of chronically ill ADHD children that receive composite treatment. In other words, it seeks to answer the question whether schools and the authorities take their rights and needs into account in accordance with applicable laws, rules and treaties. A closer look will be given to the issue of children who have been diagnosed with the disease ADHD and receive a composite treatment by a doctor's order. We will look at the statutory disclosure obligation of primary schools to the custodians of an ADHD child, i.e., how information about how the child fares in the school in his or her daily activities is communicated to the parent, and whether the school applies provably pre-announced individualised treatment measures in the event of symptoms manifesting in the child at school. We will look at how a custodial parent can follow up on appeals processes for his or her child if he or she believes him or herself not to receive adequate information about the child from the school. We will look at how a dispute about those interests is resolved in the event of a dispute between the child's custodians and the school, and whether the primary school puts the interests of the child above its own. We will look at the time-consuming appeals process and examine whether the involvement of higher authorities benefits the child in question with the process speed being as low as observed. We will consider whether the rights and the progress of the said ADHD primary school child are conformed with if the authorities can decide unilaterally to disclose information about the child to its custodial parent solely through the information program Mentor, and at the same time we will look at the school's general direct obligation of communication with the custodial parent beyond Mentor. The conclusion of the thesis is that ADHD children and their custodians are still rather far from being guaranteed the rights they enjoy by law. The appeals processes are too long and only rarely benefit the child in question. It is therefore necessary for the legislator to establish clearer procedures and guidelines so that the statutory rights of chronically ill ADHD children will be really respected within educational institutions and that all supervision of the individualised interests of the children will be strengthened dramatically, especially in primary schools.
