    Hlutverk lögmanna er hlutdrægt með málstað umbjóðenda. Því leikur mestur vafi á því hvort og að hvaða leyti lögmönnum beri að virða og taka tillit til hagsmuna þriðju aðila. Það er rannsóknarefni þessara skrifa. Fagsiðferðilegar skyldur lögmanna í einkamálum eru í forgrunni. Grunngildi engilsaxneskra og norrænna lögmanna, það er danskra og norskra, eru ólík. Fagsiðferði þessara tveggja lögmannastétta er borið saman með hliðsjón af rannsóknarefninu. Einnig er fjallað um fagsiðferði íslenskra lögmanna með það að markmiði að kanna hvort það líkist engilsaxnesku eða norrænu fagsiðferði.
    Grunngildi engilsaxneskra lögmanna er tryggð við umbjóðanda. Samkvæmt ríkjandi skilgreiningu á hlutverki þeirra eru þeir ákafir og hlutlausir fylgismenn umbjóðanda. Af því leiðir að skyldur þeirra gagnvart þriðju aðilum takmarkast við lög og siðareglur um heiðarleika gagnvart dómstólum og tillitssemi í hegðun gagnvart gagnaðila.
    Grunngildi norrænna lögmanna er faglegt sjálfstæði og heilindi. Áhersla er lögð á sjálfstæði gagnvart ríkisvaldinu, þriðju aðilum og gagnvart umbjóðanda. Hlutverk danskra og norskra lögmanna er í lögum skilgreint sem hagsmunagæsla fyrir hönd umbjóðanda í samræmi við réttmætar þarfir hans. Af því og grunngildinu leiðir að danskir og norskir lögmenn eru milligöngumenn sem hafa trúnaðarskyldur gagnvart umbjóðanda og gagnaðila. Þeim ber að stjórnast af eigin siðferðisvitund í störfum sínum.
    Ákvæði íslenskra laga þar sem hlutverk lögmanna er skilgreint dregur dám af engilsaxneskum faggildum. Íslenskum lögmönnum er heimilt að innheimta hlutfallsþóknun eins og bandarískum lögmönnum en slíkt er óheimilt í Noregi og Danmörku. Siðareglur íslenskra lögmanna líkjast í heild dönskum og norskum siðareglum og frumskylda þeirra er sú sama. Skylda íslenskra lögmanna til að gæta sjálfstæðis gagnvart umbjóðendum er hins vegar óskýr. Niðurstaðan er að fagsiðferðileg gildi íslenskra lögmanna sé á milli engilsaxneskra og norrænna gilda.

  • An attorney acting on behalf of a client is inherently biased; it is therefore uncertain whether and to what extent attorneys are obligated to take into account interests of third parties. This question forms the subject of this thesis with an emphasis on attorney’s professional ethical duties in civil litigation. The obligations of Anglo-Saxon attorneys differ significantly from the Nordic i.e. Danish and Norwegian ones, the duties of these are compared and professional ethics of Icelandic attorneys discussed to discover semblances to either the Anglo-Saxon or the Nordic model.
    Loyalty to the client is the core value of Anglo-Saxon ethics. The prevailing definition of their role is zealous and neutral partisanship, their ethical obligation towards third parties is limited to that which is explicitly stated by the law and codes of conduct; that is candor towards the court and fairness towards to the adversary.
    Independence and integrity are core values of the Nordic model. Attorneys role is defined, as advocacy in accordance with valid and legitimate needs of the client. Danish and Norwegian attorneys may therefore rightly be described as intermediaries with duties both toward their client and his adversary. They shall be governed by their own morals in their work independent of the state, third parties and the client.
    Elements of the Anglo-Saxon model can be seen in the values of Icelandic laws dictating attorneys, who unlike their Nordic counterparts, can charge contingent fees in the spirit of American attorneys, the Icelandic code of conduct overall resembles the Nordic model more closely. With the exception that an Icelandic attorneys obligation to guard their independence towards their client remains unclear. The conclusion is that the ethical values of Icelandic attorneys lie somewhere between Anglo-Saxon and Nordic values, drawing on both but relying on neither.
