    Markmið þessarar ritgerðar er að skoða hlutverk dómstóla þegar kemur að gerðardómum. Aðkoma dómstóla í gerðarmeðferð á að vera eins lítil og hægt, þar sem ein af ástæðum þess að aðilar velja gerðarmeðferð sem úrlausnarleið vegna ágreinings er til að forðast aðkomu dómstóla. Þar af leiðandi er mikilvægt að dómstólar skipti sér ekki af gerðardómum að ósekju.
    Dómstólar eiga því einungis að aðstoða gerðardóma þegar gerðardómurinn eða aðilar þess biðja sérstaklega um það. Aðkoma dómstóla getur þó verið nauðsynleg til að gerðarmeðferð virki sem best, til dæmis fyrir þær sakir að gerðardómur hefur ekki sama vald og dómstólar eða valdið til þvingunaraðgerða, valdið til að þvinga aðila til að leggja fram sönnunargögn og vitni til að veita vitnisburð. Þar af leiðandi er mikilvægt að gerðardómur geti leitað til dómstóla ef þörf er á þvingunaraðgerðum.
    Þessu hlutverki dómstóla er hægt að skipta í þrjá flokka; hlutverk dómstóla fyrir gerðarmeðferð, á meðan gerðarmeðferð stendur og eftir að gerðardómurinn hefur kveðið upp sína úrlausn.
    Verður þetta hlutverk skoðað samkvæmt lögum nr. 53/1989 um samningsbundna gerðardóma og borið saman við gerðardómslöggjöf Svíþjóðar og lagafyrirmynd UNCITRAL. Fjallað verður um
    alla þrjá flokkana en lögð verður sérstök áhersla á hlutverk dómstóla áður en að gerðarmeðferð er hafin, þá sérstaklega varðandi skyldu dómstóla til að framfylgja gerðarsamningum og verður þar skoðað hvort á dómstólum beri skylda til að notast við prima facie eða fulla skoðun á lögmæti gerðarsamningsins.
    Er niðurstaða þessa ritgerðar að prima facie skoðun sé meira í samræmi við meginreglur gerðardómsréttarins og ættu dómstólar því ekki að rannsaka á þessu stigi ofan í kjölinn gildi
    gerðarsamnings. Þá benda dómafordæmi Hæstaréttar til þess að hann ráðist einungis í prima facie. Það er þó ekki alveg ljóst hvort Hæstiréttur sé fylgjandi gerðarmeðferð eða ekki, þar sem
    nýjasta fordæmi hans bendir til hins gagnstæða.

  • Court’s role in arbitration
    The purpose of this thesis is to examine court’s role in arbitration. Courts involvement in arbitration is supposed to be as little as it can, as one of the reasons why parties choose arbitration is to avoid courts involvement. Therefore it is considered that courts should not interfere with arbitration unless asked by the parties or the tribunal. Courts involvement can however be essential to the arbitration procedure, for example for the reason that the tribunal lacks the coercive power to force parties to deliver evidence, or witnesses to give testimonial. Thus, it can be important for the tribunal during the procedure to resort to courts if needed.
    This role is divided into three categories; before arbitration, during the arbitration procedure and after an award has been rendered. This role will be shown according to the Icelandic arbitration act and compared to courts role in arbitration according to the Swedish arbitration act and the UNCITRAL MODEL LAW.
    However even though all categories of court’s role in arbitration will be reviewed, emphasize will be on courts role before arbitration. Specially regarding the role in examining the validity of the arbitration agreement, when courts have to decide whether to dismiss a case or take it into consideration, further the role to enforce arbitration agreements by using prima facie or full review.
    A study on the subject has led to the conclusion that a prima facie review is more in accordance to the principles of arbitration, thus at this point courts should not examine the arbitration agreement extensively. Furthermore, cases from the Supreme Court give strong indication that it uses a prima facie review of the arbitration agreement. However it is not certain whether the Court interprets a
