  • Í þessari ritgerð er fjallað um upphaf ráðningar hjá hinu opinbera og þau lög og reglur sem hið opinbera þarf að fylgja í ráðningarmálum. Ráðningar hjá hinu opinbera eru ávallt stjórnvaldsákvörðun og lýtur því allt ráðningarferlið ákvæðum stjórnsýslulaga ásamt lögum um réttindi og skyldur starfsmanna ríkisins nr. 70/1996. Lögð var áhersla á 7. gr. laga nr. 70/1996 sem fjallar um auglýsingaskyldu hins opinbera en að baki hennar liggja tvö sjónarmið, annars vegar verðleikaregla stjórnsýsluréttarins og hins vegar það sjónarmið að veita beri öllum tækifæri til að sækja um laus störf hjá ríkinu. Álit umboðsmanns Alþingis voru skoðuð í þessu samhengi og kom í ljós að stjórnvöldum mistakist oft að uppfylla lagaskyldur sínar í ráðningarmálum. Frá setningu laga nr. 70/1996 og reglna um auglýsingu lausra starfa hefur orðið jákvæð þróun er kemur að stjórnvöldum að uppfylla auglýsingaskyldu sína en enn er þó rými til bætingar.

    This thesis will cover the beginning process of recruitment in the public sector as well as those laws and regulations that the public sector has to follow in recruitment procedures. Public sector recruitment is always a administrative decision and the entire recruitment process is therefore subject to the provisions of the Administrative Procedures Act nr. 37/1993, as well as the Government Employees Act no. 70/1996. Emphasis was placed on art. 7. law no. 70/1996, which states the public sector´s obligation to advertise through two focal points: first to honour the principle of merit in the Administrative Procedures Act, and second the viewpoint that everyone should be given the opportunity to apply for public sector vacancies. The opinion of the Parliamentary Ombudsman was examined in this context and it was revealed that the government had many failures in fulfilling its legal obligations when it comes to recruitment procedures. From the enactment of law no. 70/1996 and the rules on advertising of open jobs, there has been a positive development in how the public sector fulfills its advertising obligations although there is still room for improvement.
