  • Reglur um sönnun hafa allar einn sameiginlegan tilgang: að stuðla að því að rétt niðurstaða fáist í hverju dómsmáli. Í ritgerð þessari verður leitast við að varpa ljósi á sönnunarmat og sönnunarkröfur sem dómstólar gera í efnahagsbrotamálum með hliðsjón af dómaframkvæmd. Byrjað verður á því að fjalla almennt um efnahagsbrot og sérstöðu þeirra en áhersla svo lögð á að skoða hvernig dómstólar meta sönnunargildi þeirra sönnunargagna sem lögð eru fram í efnahagsbrotamálum.
    Ritgerðin skiptist í níu kafla. Í inngangskafla er rannsóknarspurningin kynnt. Í öðrum kafla ritgerðarinnar er almenn umfjöllun um efnahagsbrot. Í þriðja kafla er fjallað um rannsókn og saksókn efnahagsbrotamála. Í fjórða kafla er svo rætt um þróun efnahagsbrotamála, orsakir þeirra, viðhorf almennings til brotanna og gerendur. Í fimmta kafla er tekin fyrir sérstaða efnahagsbrotamála og litið á þá þætti sem helst einkenna efnahagsbrotamál. Í sjötta kafla er fjallað um dómstóla og efnahagsbrot og þeirri spurningu velt upp hvort hætta sé á að samfélagsumræða hafi áhrif á störf dómstóla. Í sjöunda kafla eru taldar upp helstu meginreglur er tengjast sönnun í efnahagsbrotamálum. Í áttunda kafla er svo fjallað almennt um sönnun í efnahagsbrotamálum. Þar verður einnig farið yfir sönnunarfærslu, sönnunarmat og sönnunarkröfur efnahagsbrota auk þess sem skoðuð er dómaframkvæmd þar sem reynt hefur á sönnunargildi einstakra sönnunargagna í efnahagsbrotamálum. Í lokakaflanum eru svo helstu niðurstöður ritgerðarinnar dregnar saman.
    Niðurstaða höfundar er sú að þrátt fyrir að sönnunargögn í efnahagsbrotamálum séu að mörgu leyti frábrugðin sönnunargögnum í öðrum brotaflokkum, bæði hvað varðar tegund og magn, sé ekki mögulegt að draga aðra ályktun en þá að sönnunarmat sé nokkuð svipað í efnahagsbrotamálum og í öðrum sakamálum og sönnunarkröfur einnig. Efnahagsbrotamál eru hins vegar fremur ný tegund afbrota og hefur því ákæruvaldið og dómstólar þurft að laga störf sín og sérfræðiþekkingu að þeim aukna fjölda flókinna efnahagsbrotamála sem réttarvörslukerfið hefur þurft að takast á við eftir bankahrunið 2008.

    Evaluation of evidence and quantum/quality of evidencerequired in white collar criminal cases.
    Rules about proof have all one common purpose: to establish and be the basis for a right conclusion in a court case. In this thesis there is examined evaluation of evidence and the quantum/quality of evidence that courts require in white collar criminal cases, with reference to judgments (court precedents). The thesis starts with general chapters about white-collar crimes and what distinguishes that type of crimes from others, with emphasis on examining how courts evaluate evidence that is presented in a white-collar criminal case.
    The thesis is divided into nine chapters. In the introduction chapter the research question is presented. In chapter number two there is a general definition of a white-collar crime. The third chapter is about investigation and prosecution in white-collar criminal cases. The fourth chapter is about how this type of crimes has developed, the main causes, the general public view on these crimes and the perpetrators. The fifth chapter is about what distinguishes white-collar crimes from other crimes and the main differences are examined. The sixth chapter is about the court proceedings when dealing with white-collar crimes and the question is presented whether public view can influence the decision of the court or the proceedings. The seventh chapter includes some of the main rules and regulation about proof in a white-collar criminal case. In the eight chapter there is a general overview of how evidence are presented in this type of cases. In that chapter there is also examined how different types of evidence are presented to the courts, evaluation of evidence and the required quantum/quality of evidence according to the courts. Judgments are examined where the issue of proof has been specially addressed in recent court cases, and also different types of evidence are examined specifically. In the final chapter the main conclusions are summarized.
    The author’s conclusion is that evidence in white collar crimes are in some ways different then in other criminal cases, both in regards to types and quantity. Despite this fact, the authors conclusion from examining judgments, is that evaluation of evidence and requirements of the court in regards to type or quantum/quality of evidence is the relatively the same with white-collar crimes as with other type of crimes. White-collar crimes are on the other hand relatively new phenomena and the prosecution authorities and the courts have to adapt its work and its specialized knowledge in accordance with the increased number of complicated white-collar crimes in modern society.
