    Í fyrsta kafla er efni ritgerðarinnar afmarkað og þeirri rannsóknarspurningu varpað fram hvort áætlun Seðlabanka Evrópu um tafarlaus viðskipti með ríkisskuldabréfa á eftirmarkaði sé lögmæt í ljósi valdheimilda sambandsins og seðlabankans. Í öðrum kafla ritgerðarinnar fjallað um skiptingu valds og flokka valdheimilda í upphafskafla sáttmálans um starfshætti Evrópusambandsins, auk meginreglna um beitingu valds. Í þriðja kafla er fjallað um Efnahags- og myntbandalagið, uppbyggingu þess og útfærslu valdheimilda sambandsins á sviði efnahagsmála og peningamála. Jafnframt er þar fjallað um skuldavanda ríkja á evrusvæðinu og dóm Evrópudómstólsins í máli Pringle vegna Stöðugleikasjóðs Evrópu. Í fjórða kafla er fjallað um áætlun Seðlabanka Evrópu um tafarlaus viðskipti með ríkisskuldabréf á eftirmarkaði (e. outright monetary transactions), úrskurð þýska stjórnlagadómstólsins sem óskað hefur forúrskurðar Evrópudómstólsins vegna aðgerðar seðlabankans og álit lögsögumanns dómstólsins í því máli. Þá er lögmæti áætlunar Seðlabanka Evrópu metið í ljósi hlutverks bankans, markmiðs skuldabréfaáætlunarinnar, efnis hennar og tæknilegrar útfærslu. Jafnframt er skoðað hvort tafarlaus kaup ríkisskuldabréfa samkvæmt áðurnefndri áætlun sé lögmæt í ljósi meðalhófsreglu og ákvæða starfsháttasáttmálans um bann við fjármögnun aðildarríkjanna. Fimmti kafla ritgerðarinnar inni heldur samantekt og þá niðurstöðu að áætlun Seðlabanka Evrópu um tafarlaus viðskipti með ríkisskuldabréf á eftirmarkaði sé líklegast lögmætur hluti af peningamálastefnu sambandsins sem bankinn mótar og framkvæmir. Aðgerð seðlabankans virðist því rúmast innan valdheimilda sambandsins á sviði peningamála. Sambandið brýtur því líklegast ekki í bága við lögmætisreglu Evrópuréttar um veittar valdheimildir. Að lokum virðist skuldabréfaáætlun seðlabankans ekki fara í bága við ákvæði starfsháttasáttmálans sem banna fjármögnun aðildarríkjanna í ljósi dómaframkvæmdar.

  • The thesis subject is delimited in the first chapter which includes the following thesis statement: is the outright monetary transactions programme of the ECB legitimate in light of Union competences? Division of powers between the member states and the Union, categories of Union competences and certain principles governing those competences are discussed in the second chapter. The Economic and Monetary Union is discussed in the third chapter, including subjective provisions on Union competences in monetary policy, economic policy and the role of the ECB. The chapter additionally addresses the sovereign debt crisis in the Eurozone, the European Stability Mechanism and the Pringle-judgment of the European Court of Justice. The fourth chapter includes a detailed discussion on the Outright monetary transactions programme of the ECB, the decision of the Bundesverfassungsgericht (German constitutional court) to request a preliminary ruling of the CJEU, and the recently published opinion of Advocate General Villalón‘s in the case. The legitimacy of the outright monetary transactions programme is assessed in light of ECB competences, the programme aim, its content and technical features. The legitimacy of the measure is additionally assessed in light of the principle of proportionality and provisions of the TFEU on the prohibiton of monetary financing of the member states. The fifth and final chapter includes the thesis conclusions that the outright monetary transactions programme is likely a legitimate part of the Union‘s monetary policy which the ECB defines and implements. The central bank‘s measure therefore seems to fall within Union competences in the field of monetary policy. Therefore the Union does not seem to violate the principle of conferral. Finally, in light of recent jurisprudence, the outright monetary transactions programme does not seem to violate TFEU provisions which prohibit the monetary financing of member states.
