  • Meginefni ritgerðarinnar er umfjöllun um heimild dómara til að dæma sameiginlega forsjá og er það jafnframt titill hennar. Höfundur afmarkar efnið í upphafi með því að fara yfir þá þróun barnalaga sem snertir forsjá, hvað felst í sameiginlegri forsjá og þróun heimildar dómara til að dæma sameiginlega forsjá í norrænum rétti og hér á landi. Þá eru reifuð helstu sjónarmið sem dómara ber að hafa í huga við mat á því hvort dæma skuli sameiginlega forsjá. Einnig er ítarlega gerð grein fyrir sjónarmiðum sem fram komu í dómi Hæstaréttar í máli nr. 63/2014 en dómurinn er fyrsti sinnar tegundar á Íslandi. Í málinu reyndi í fyrsta skipti á heimild dómara til að dæma sameiginlega forsjá.
    Niðurstaða höfundar er að þau sjónarmið sem dómara beri að líta til séu skýr eins og þau koma fram í lögum nr. 61/2013 um breytingar á barnalögum nr. 76/2013 og lögskýringargögnum. Rökin fyrir lögfestingu dómaraheimildarinnar eru sterk, einkum vegna þess að ef dómari hefur ekki þá heimild í forsjármáli fer réttarkerfið gegn þeirri grundvallarreglu barnaréttar að dæma það sem barni er fyrir bestu. Telji dómari í forsjármáli að sameiginleg forsjá sé barni fyrir bestu verður dómaraheimildin að vera í lögum svo hægt sé að dæma sameiginlega forsjá þegar það á við.
    Forsjármál eru eins misjöfn og þau eru mörg. Það er ekki hægt að fullyrða að sameiginleg forsjá sé barni aldrei fyrir bestu þó að annað foreldrið hafi höfðað mál fyrir dómi. Að allri umfjöllun virtri, einkum sjónarmiðum sem varða með- og mótrök fyrir dómaraheimildinni, dregur höfundur þá ályktun að heimild dómara til að dæma sameiginlega forsjá sé framför í íslensku réttarkerfi. Hins vegar megi dæmd sameiginleg forsjá ekki verða einhvers konar meginregla heldur þurfi ætíð að skoða hvert mál fyrir sig.

    The main content of this thesis is the authorization of judges to rule in favour of joint custody in custody disputes. Firstly, the author explains the development of the Children's Act as it pertains to custody of children, clearly defines exactly what constitutes joint custody and explains the development of the authorization of judges to rule in favour of joint custody, both in the Nordic courts as well as in Iceland. Secondly, are recapitulated the major considerations judges should consider in assessing whether joint custody should be ruled. Lastly, thorough review is carried out of different viewpoints in the Icelandic Supreme Court´s ruling in case no. 63/2014, which, is the first case of its kind in Iceland. In this particular case, the authorization of a judge to rule in favour of joint custody was tried and tested.
    The conclusion is that the view a judge should consider prior to rendering a judgment are clear as stated in the law no. 61/2013 regarding to the legal changes in Child Law no. 76/2013. The argument for ratification of a judge‘s authorization is strong. Hence, if a judge doesn’t have authorization in a custody case, the legal system goes against basic principle of child law, ensuring judgements that are based on what is in the best interest of a child. If a judge deems joint custody is in the best interest of the child, this authorization must be allowed by law in order for the judge to render a judgement of joint custody. In a case where a parent brings a custody case to the court, it is impossible to claim that a joint custody is never in the best interest of the child due to variety of cases. With respect to all viewpoints, arguments that either for or against, the authorization of judges to render judgement of joint custody is step forward for the Icelandic legal system. Nevertheless, authorizing joint custody must not become the main rule in custody cases as each individual case must be reviewed and judged on its own.
