Grá svæði í þjónustu við börn

Abstract

Samningur Sameinuðu þjóðanna um réttindi barnsins nr. 18/1992 eða Barnasáttmálinn var löggiltur hér á landi árið 2013. Í Barnasáttmálanum er lögð áhersla á almennan rétt barna sem og sérstakan rétt og vernd sem þau eiga skilið vegna þroska og aldurs. Í þriðju grein Barnasáttmálans segir að það eigi ávallt að byggja ákvarðanir í málefnum barna á því sem er þeim fyrir bestu.Ritgerð þessi fjallar um grá svæði í þjónustu við börn með sértækar raskanir á Íslandi. Grá svæði eru skilgreind sem óskilgreind svæði. Þá er átt við að börn, sem eru með sértækar raskanir og lenda á gráum svæðum, fái ekki þá þjónustu sem þau þurfa á að halda vegna þess að ábyrgðarsvæði stofnana skarast. Þetta hefur ekki áður verið rannsakað hér á landi. Markmið rannsóknarinnar er að skoða þjónustu við börn með sértækar raskanir hér á landi og hvort þjónustan sé í samræmi við ákvæði Barnasáttmálans.Í þessu skyni voru tekin átta viðtöl við fagmenn sem vinna að þjónustu við börn og aðstandendur þeirra á höfuðborgarsvæðinu og nágrannasveitarfélögum. Helstu niðurstöður eru þær að allir viðmælendur vildu heildrænna kerfi með meira samstarfi og betri skilgreiningum í þjónustunni við börn. Allir viðmælendur þekktu til grárra svæða og sex af átta viðmælendum nefndu að börn með fjölþættan vanda og geðraskanir væru helst á gráum svæðum. Tveir nefndu að þetta ætti einnig við börn með ADHD. Allir viðmælendur utan einn álitu að ekki væri verið að fylgja Barnasáttmálanum í þjónustu við börn hér á landi. Þessar niðurstöður gefa til kynna að það þurfi að bæta talsvert þjónustu við börn með sértækar raskanir hér á landi.Lykilorð: þjónusta, sértæk aðstoð, Barnasáttmálinn, grá svæði, börn.

The United Nations Convention on the Rights of the Child was ratified in Iceland in 2013. The treaty emphasizes the general rights of children, and the special rights and protection which they are entitled to in accordance with their age and developmental abilities. Article 3 of the treaty stresses that decisions that concern children must always be guided by their best interest.This thesis deals with the so-called gray areas in the services of children with special needs. Gray areas have been described as being undefined, which means that children with special disorders who fall within a gray area are not getting the care that they need because of the overlap between service areas. This subject has not been previously investigated in Iceland. The main purpose of the study was to look at services that are provided to children with special needs and whether these services fulfilled the requirements of the treaty. In order to answer the research questions, eight interviews were conducted with professionals who work with children with special needs and their relatives in the Reykjavík area and the surrounding communities.The results indicated that the interviewees unanimously agreed that there was a need for a more holistic approach that would be based on more cooperation and better definitions when it came to providing services to this group of children. All of the interviewees knew of gray areas. Six of them mentioned that children with multiple diagnoses and psychological disorders were the most likely to fall within a gray area. Two of the interviewees remarked that this applied to children with ADHD. With the exception of one participant, the interviewees considered the services to fail to meet the standard of the UN Convention on the Rights of the Child. These results indicate that the services for children with special disorders need to be considerably improved in Iceland.Key words: Services, Special Needs, Convention on the Rights of the Child, Children.
