  • Meginviðfangsefni þessarar ritgerðar er að skoða réttarstöðu maka í hjúskap, horfins aðila, sem annað hvort hefur verið talinn látinn með dómi samkvæmt III. kafla, einkum 5. og 6. gr. laga um horfna menn nr. 44/1981 eða eftir að úrskurður dómstóls hefur verið kveðinn upp um að bú hins horfna skuli fara með sem dánarbú, skv. 1. mgr. 1. gr. áðurnefndra laga. Rannsóknarspurning ritgerðarinnar er: Er þörf á réttarbótum fyrir maka horfins manns til að fá hjúskap lokið?
    Almennt getur hjúskap lokið með þrennum hætti; Andláti, lögskilnaði eða ógildingu, sbr. 5. gr. hjúskaparlaga nr. 31/1993. Mismunandi réttarreglur gilda eftir því hvernig hjúskap lýkur.
    Þá verður kannað sérstaklega hvort og þá hvernig þörf sé að réttarbótum hvað varðar heimildir vegna lok hjúskapar til handa maka í slíkum tilfellum sem að ofangreinir, því ef dánarlíkur reynast rangar og hinn horfni birtist aftur heldur hjúskapur þeirra gildi sínu nema að eftirlifandi maki hafi gifst að nýju, sbr. 20. gr. laga um horfna menn.
    Í þessu samhengi verður skoðað hvort það væri réttarbót ef eftirlifandi maki gæti fengið heimild til lögskilnaðar á grundvelli 37. gr. hjúskapalaga nr. 31/1993 vegna samvistaslita til tveggja ára hið skemmsta frá því að dómur eða úrskurður er kveðinn upp. Annar möguleiki væri á þá leið að hægt væri að samtvinna þessi úrræði á þá leið að fyrst yrði heimild til lögskilnaðar, vegna samvistarslita og um búskiptin færi eftir reglum hjúskaparlaga. Búshluti dánarbúsins yrði þá varveittur sérstaklega, skv. 3. gr. laga um horfna menn, og eftir að tímamark endurkröfureglna hvað varðar rangar dánarlíkur lyki skv. 14 gr. laganna, þá væri hægt að skipta dánarbúi hins horfna skv. erfðalögum nr. 8/1962 og lögum um skipti á dánarbúum o.fl. nr. 20/1991. Samhliða þessu verður einnig skoðuð réttarstaða annarra erfingja sem hafa hagsmuna að gæta vegna horfins manns.

    The main objective with this thesis is to review the legal status of the living spouse in a marriage where either the other spouse is missing and has been declared dead by a District court verdict under the section III, regarding to the Articles no. 5 and no. 6 Act on missing person no. 44/1981, or where the District court has ruled that the missing persons properties should go under estate, according to Articles 1. in the same Act.
    In general, a marriage can end in one of three ways: by death; by divorce; or by annulment, according to Article no. 5 in the Act of Marriage no. 31/1993. Furthermore, the legal consequences of the end of the marriage depend on how it ended. This begs the question, is the justice system working to the benefit of the living spouse in such a marriage, or is there a need for significant improvement in how the system treats such people, and in how it addresses the end of marriage should the missing spouse be discovered to be still living.
    Currently, this type of marriage, where a spouse that has been declared dead is then discovered to be living, is still considered valid, unless the spouse who was missing has remarried, according to Article no. 20 on missing person Act. This problem has several possible solutions. First, the spouse who did not go missing, could get permission to divorce on the basis of Article 37 of the Act of Marriage no. 31/1993, which allows the dissolution of a partnership between spouses who have not lived together for at least two years. Alternatively, there could be a two-step solution: first, the spouse who was not missing could obtain permission to divorce because of the dissolution of their partnership after two years, and would then preserve the estate of the missing spouse, according to Article no. 3 of the Missing Persons Act. Then, when the time limit determined in Article no. 14 has expired, if the missing spouse is found to still be alive, that spouse could reclaim their property, if not, the remaining spouse would inherit the estate, according to the Act of Inheritance law no. 8/1962 and Act. of division of estates no. 20/1991.
