  • Samkeppnisréttur samanstendur af reglum sem hafa þann tilgang að vernda virka samkeppni með það að markmiði að hámarka velferð neytenda. Stofni fyrirtæki markmiðinu í hættu er þörf á að meta hvort og þá hvernig samkeppnisreglum verði beitt. Við matið getur skipt sköpum hvort fyrirtæki hafi markaðsstyrk. Þegar fyrirtæki á markaði kaupenda hefur mikinn markaðsstyrk nefnist það kaupendastyrkur. Líkt og heiti ritsins ber með sér er markmið þess að gera grein fyrir fyrirbærinu kaupendastyrkur. Jafnframt er markmiðið að gera grein fyrir því hvernig mismunandi tegundir kaupendastyrks birtast í samkeppnisrétti.
    Í kaupendastyrk felst að kaupanda er kleift, í krafti mikils markaðsstyrks, að knýja fram hagstæðari kjör í viðskiptum en ella. Það samræmist ekki markmiði samkeppnisréttar að fyrirtæki búi yfir miklum markaðsstyrk. Við þær aðstæður er aukin hætta á að markaðsstyrkur verði misnotaður. Slíkt má þó ekki skilja sem svo að kaupendastyrkur gangi gegn markmiði samkeppnislaga. Veltur það á því um hvora tegund kaupendastyrks er að ræða. Ástæða er til að meta kaupendastyrk við tvenns konar aðstæður. Í fyrsta lagi þegar kaupandi og seljandi búa yfir miklum markaðsstyrk (e. countervailing buyer power). Sú tegund er talin hafa jákvæð áhrif á samkeppni sökum þess að kaupendastyrkur veitir efnahagslegum styrk fyrirtækis mótvægi þannig að hvorugt fyrirtækið getur misnotað markaðsstyrk sinn. Því er markmiði samkeppnisreglna ekki stofnað í hættu. Í öðru lagi er kaupendastyrkur metinn þegar kaupandi býr yfir miklum markaðsstyrk en seljandi ekki (e. monopsony power). Sú tegund er líkleg til að hafa neikvæð áhrif á samkeppni til lengri tíma litið. Ástæðan er sú aukin hætta er á að kaupandi viðhafi samkeppnishamlandi háttsemi þegar ekkert fyrirtæki á markaði seljenda hefur efnahagslegan styrk. Við slíkar aðstæður er þörf á að að meta hvort og þá hvernig samkeppnisreglum verði beitt í því skyni að vernda virka samkeppni með það að markmiði að hámarka velferð neytenda.

    Competition law consists of rules that are intended to protect the process of competition in order to maximize consumer welfare. A central concern of these rules is that a firm or firms with market power are able, in various ways, to harm consumer welfare. In very general terms, buyer power is market power on the purchasing side of a market. Like the name of this thesis implies, the aim is to define the concept of buyer power. In addition, the aim is to explain how different types of buyer power appear in competition law.
    Buyer power refers to a situation which exists when a firm has a sufficient amount of market power and is able to obtain from a supplier more favorable terms of trade than those available to other buyers. Economic theory suggests that buyer power may offer efficient benefits but can potentially be anti-competitive. Thus, it can be seen in either a positive or negative light. Based on the effect of buyer power on consumer welfare, competition law distinguishes between two types. The first type is countervailing buyer power that may counterbalance the bargaining strength of suppliers. Under these circumstances the parties set a quantity that would maximize their joint profits and subsequently divide the profits by bargaining over the price. Eventually it may offer benefits and have a positive effect on consumer welfare. Therefore, this type of buyer power is thought to be good in competition law. The second type is referred to as monopsony power. That is the market power in procurement arising from the lack of effective competition between buyers and may be detrimental to consumer welfare. When buyer power has a harmful effect on competition and consumer welfare it is up to competition authorities to assess the appropriate treatment of the anti-competitive behavior to protect the process of competition in order to maximize consumer welfare.
