    Tækniframfarir undafarna áratugi hafa í senn skapað tækifæri og vandamál. Eitt af þeim vandamálum sem upp hafa komið er þegar viðkvæmar persónuupplýsingar lenda í röngum höndum og valda einstaklingum fjárhagslegu og/eða óefnislegu tjóni. Almenna persónuverndarreglugerð Evrópusambandsins, sem Ísland innleiðir í gegnum EES-saminginn, markar tímamót. Hún boðar strangari og samræmda stefnu yfirvalda með því að koma á regluverki um aðila sem afla og vinna með persónuupplýsingar.
    Meginumfjöllunarefni þessarar lokaritgerðar birtast í tveimur en nátengdum hlutum. Annars vegar verður rýnt í hlutverk persónuverndar-fulltrúa eins og það birtist í Almennu persónuverndarreglugerðinni og þá möguleika sem starfið hefur á að þróast í framtíðinni. Hins vegar verður fjallað um ábyrgð fulltrúans, hvort hann beri yfir höfuð ábyrgð og reynist svo vera, á hvaða lagagrundvelli. Það er niðurstaða höfundar að hlutverk persónuverndarfulltrúa muni þróast hratt á næstu árum og á eftir að verða mikilvægara og umfangsmeira en reglugerðin segir til um, m.a. vegna þeirrar miklu sérfræðikunnáttu sem af honum er krafist. Í ljósi þekkingar hans og umfangs stöðunnar er það óhjákvæmilegt að hann verði látinn bera ábyrgð á þeim verkefnum sem honum ber að sinna á grundvelli landsréttar viðkomandi lands.

  • Unprecedented technological developments in the last decades have created both opportunities and problems. One of those problems is when personal data is misplaced and individuals suffer material or non-material damages. The EU General Data Protection Regulation (GDPR), which Iceland incorporates through the EEA agreement, is a turning point in the EU effort to put restrictions on those who gather and process personal data.
    The main topic of this thesis is twofold. On the one hand the role of the Data Protection Officer (DPO) will be examined as it appears in the GDPR and the possibilities it has to evolve in the future. And on the other hand it will be discussed if the DPO can be held accountable for negligence, and if so, on what legal grounds. It is the author’s conclusion that the role of the DPO will develop rapidly over the next few years and will become more important and comprehensive than the GDPR states, i.a. due to his expertise that is required of him. In the view of his skills and the extent of the position, it is inevitable that the DPO will be held responsible, for the tasks that he is obliged to perform, on the grounds of internal law of the EU countries.
