Réttarstaða meðlagsgreiðenda og umgengnisforeldra á Íslandi, er breytinga þörf?
Í áratugi hefur réttarstöðu meðlagsgreiðenda og umgengnisforeldra verið ábótavant hér á landi. Réttarbætur í málaflokknum hafa að mestu komið til eftir árið 2000 að fyrirmynd Norðurlandanna og hafa skilað sér seint inn í íslenskan rétt. Með ritgerðinni er leitað svara við rannsóknarspurningunni hver réttarstaða meðlagsgreiðenda og umgengnisforeldra sé á Íslandi og hvort að breytinga sé þörf. Til þess að svara rannsóknarspurningunni er lagaumhverfi og meðlagskerfi hér á landi skoðað og borðið saman við lagaumhverfi og meðlagskerfi í öðrum löndum. Þá er lagaleg og efnahagsleg staða umgengnisforeldra og meðlagsgreiðenda borin saman við stöðu lögheimilisforeldra og meðlagsþiggjenda. Þar að auki er skoðuð Dómaframkvæmd Hæstaréttar Íslands, álit umboðsmanns Alþingis og tölfræðileg gögn sem snerta réttarstöðu hópanna sem rannsóknarspurningin snýr að. Niðurstöðurnar eru þær að réttarstaða meðlagsgreiðenda og umgengnisforeldra hér á landi sé óviðunandi miðað við þær skyldur sem lagðar eru á hópana samkvæmt lögum. Réttarstaða þeirra er mun betur tryggð í samanburðarlöndunum, þar sem meðlagskerfi og lagaumhverfi hafa verið uppfærð í samræmi við nútíma áherslur og hugmyndir um jafna ku beggja foreldra í uppeldi barna sinna. Laga- og kerfisbreytinga er þörf sem stuðlar að úrbótum á óviðunandi réttarstöðu meðlagsgreiðenda og umgengnisforeldra. Slík breyting myndi annars vegar tryggja foreldrajafnrétti og hins vegar tryggja að meginregla barnaréttarins um að gera skuli það sem sé barninu fyrir bestu, væri ávallt í fyrirrúmi.
The legal status of people who pay childsupport and conduct parents in Iceland, are changes needed?
For decades, the legal status of non-resident parents and child support payers has been lacking in Iceland. Improvements in these groups’ legal status have mainly been implemented after the year 2000 and have been modeled on corresponding laws Scandinavian countries. This thesis seeks answers to the research question: What is the legal status of child support payers and non-resident parents in Iceland, and whether changes are needed. In order to answer the research question, Icelandic law is be examined in particular as well as ideas about changes in the legal environment and the child support system in Iceland. The legal environment and the child support system in Iceland is compared to other countries. The differences in legal and economic status between non-resident parents and child support payers on one hand, and residential parents and child support recipients on the other hand is be compared. Furthermore, the decisions of the Supreme Court, the opinions of the Parliamentary Ombudsman and statistical data concerning the status of the groups to which the research question relates, are examined. The main conclusion is that the legal status of child support payers and non-resident parents is unacceptable in terms of the obligations imposed on these groups by law. The legal status of these groups is far better protected in the comparison states, where child support systems and the legal environment have been updated in line with the modern ethos emphasis on equal participation of both parents in child rearing. A legal and systemic change is needed that would remedy the poor legal status of the vast majority of non-resident parents and child support payers. Such legislative improvements would ensure parental equality and comply with the principle of children's rights, that the best interest of the child should always be a primary consideration.
