    Á Íslandi er bann við áfengisauglýsingum staðfest í lögum. Þó eru þær sjáanlegar hvert sem litið er. Hvernig stendur á því og hvaða tilgangi þjónar áfengisauglýsingabann yfir höfuð?
    Áfengisframleiðendur hafa fyrir löngu séð möguleikana sem felast í lögvernduðum undantekningum á áfengisauglýsingabanni og notast við ólíkar leiðir til þess að auglýsa áfengi í skjóli þeirra. Léttölsauglýsingar með skírskotun í bjór og keyptar kynningar eða umfjöllun undir formerkjum lífsstíls í fjölmiðlum eru tvær af þeim leiðum sem algengar hafa verið. Viðvera Íslendinga á samfélagsmiðlum hefur opnað fyrir aðgengi að áfengisauglýsingum sem alls óvíst er hvort íslensk lög ná til.
    Tilgangur þessa verkefnis var að rannsaka á hvaða grundvelli áfengisauglýsingabann er byggt og hvers vegna löggjöfin virðist hleypa eins mörgum undantekningum í gegn og raun ber vitni. Upplýsingum var safnað um viðeigandi löggjöf sem tengist áfengisauglýsingum ásamt því að alþjóðlegar rannsóknir um áhrif áfengisauglýsinga á áfengisneyslu ungmenna voru skoðaðar. Gömul rannsókn á íslenskum áfengisauglýsingum í prentmiðlum var endurtekin, þó af mun minni stærðargráðu, og skoðaðar voru ýmsar áfengistengdar Facebook-síður.
    Niðurstöður leiddu í ljós að rannsóknum um áhrif áfengisauglýsinga er ábótavant eða þær eru óljósar. Hvorki er hægt að segja örugglega til um að áfengisauglýsingar valdi aukinni áfengisneyslu, né að þær hafi engin áhrif. Viðfangsefnið reynist erfitt í rannsóknum, oft vegna þess að rannsóknir þurfa að reiða sig á sjálfsmat þátttakenda, eða þá að gerðar eru langtímarannsóknir á börnum á viðkvæmu aldursbili sem leiða takmarkaðar upplýsingar í ljós um áhrif auglýsinganna. Á Íslandi hefur verið tekin sú ákvörðun að leyfa lýðheilsunni að njóta vafans og ritskoða áfengisauglýsingar á grundvelli lýðheilsusjónarmiða.
    Snertiflötur íslenska áfengisauglýsingabannsins er þó of lítill þar sem lögverndaðar undantekningar hafa opnað á leiðir fyrir áfengisframleiðendur til þess að sneiða hjá reglunum. Það er gert með því annars vegar að auglýsa léttöl með skírskotun til bjórs með sama nafni og hins vegar að dulbúa auglýsingarnar sem kynningar eða umfjöllun í blöðunum. Þar að auki lifa áfengistengdar Facebook-síður góðu lífi á íslenskum samfélagsmiðlum, sem löggjöfin virðist ekki ná yfir. Endurskoðun eða endurskilgreining á núverandi áfengisauglýsingalögum er eitt af því sem nauðsynlegt má teljast ef íslensk stjórnvöld ætla sér að viðhalda áfengisauglýsingabanni í samfélaginu.

  • An alcohol-advertising ban is in place in Icelandic law, but still they seem to be present everywhere. What is the reason behind it, and to which purpose does the alcohol-advertising ban serve?
    Alcohol producers found out long ago where the potential lies for the statutory exceptions of the ban and have used a few different methods in order to keep on advertising alcohol legally. One of the methods is advertising light beer with a direct and obvious reference to an alcoholic beer of the same name and brand. Another method is paid coverage for an alcoholic product, as there are no restrictions on coverage. The presence of Icelanders on social media has also opened up for a method for advertising alcohol that the government might not even be able to control.
    The purpose of this thesis is to research on what grounds the alcohol-advertising ban is built, and why the legislations seems to allow so many other loopholes for advertising alcohol. Information was collected on all Icelandic legislations relevant to alcohol advertisements, as well as international studies on the effects of alcohol advertisements. An old research was re-enacted, on a smaller scale, on the amount of alcohol advertisements in Icelandic print media, and information gathered on a few Icelandic alcohol-related Facebook pages.
    The outcome showed that not very many studies on the effect of alcohol-advertisement demonstrated any substantial evidence either in favour or against the negative effects alcohol advertisements can have. Many of the studies found a correlation in some form but conclusive evidence that supported the final argument was severely lacking. The subject proved to be hard to research, as most studies relied either on self-reported exposure, or on long-term studies on adolescents with very limited information on the effect of alcohol advertisements. In Iceland, the decision to ban the alcohol advertisements was made as a public health decision, to err on the side of caution when it comes to public health.
    The area of influence of the alcohol-advertising ban seems to be too small, as statutory exceptions have opened up opportunities for alcohol produces to sway the rules, by the aforementioned methods of advertising light beer with a clear and obvious reference to a beer by the same name and brand, or to disguise advertisements as coverage in media. As there seems to be no stop on Icelandic alcohol advertisements on Facebook, the Icelandic government should see the importance of reviewing or redefining the legislation, if they are to maintain the ban on alcohol advertisements.
