    Aðferðafræði Mannréttindadómstóls Evrópu í tjáningarfrelsismálum
    Meginviðfangsefni ritgerðar þessarar er hvort Hæstiréttur og íslenskir dómstólar almennt fari eftir aðferðafræði Mannréttindadómstóls Evrópu við úrlausn tjáningarfrelsismála. Samhliða þessu var athugað hvert svigrúm aðildarríkjanna væri til þess að finna jafnvægi milli friðhelgi einkalífs og tjáningarfrelsis. Til að kanna þetta var farið yfir helstu dóma Mannréttindadómstóls Evrópu er varða skörun tjáningarfrelsis og friðhelgi einkalífs og borin saman við úrlausnir íslenskra dómstóla. Til þess að gera þessu fyllilega skil var nauðsynlegt að fara yfir þá aðferðafræði sem Mannréttindadómstóllinn tileinkar sér við úrlausn slíkra mála og hvaða skýringarreglur gilda um sáttmálann. Í því samhengi var litið sérstaklega til áfellisdóma Mannréttindadómstólsins vegna úrlausna íslenskra dómstóla er varða tjáningarfrelsisákvæðið og skörun þess við friðhelgi einkalífs. Þá var það skoðað hvort þeir áfellisdómar hefðu breytt úrlausnum Hæstaréttar og þá sérstaklega litið til tímabilsins eftir 2012 þegar íslenska ríkið tapaði þónokkrum málum vegna þessa. Niðurstaðan er sú að Ísland uppfyllti ekki skilyrði Mannréttindasáttmála Evrópu með því að taka ekki tillit til aðferðafræði Mannréttindadómstóls Evrópu í tjáningarfrelsisbrotamálum sem snúa að skörun við friðhelgi einkalífs. Eftir ítrekaðan málarekstur varðandi samningsbrotamál er varða tjáningarfrelsi og friðhelgi einkalífs fyrir Mannréttindadómstólnum þá breyttist nálgun Hæstaréttar að miklu leyti og fór að mestu leyti að líkjast úrlausnum Mannréttindadómstóls Evrópu í sambærilegum málum. Þannig má segja að Hæstiréttur fari í dag að mestu eftir þeirri aðferðafræði sem Mannréttindadómstóll Evrópu leggur upp með í slíkum málum. Þá er aðildarríkjunum að jafnaði játað ákveðið svigrúm til að komast að niðurstöðu í jafnvægismatinu á skörun tjáningarfrelsis og friðhelgi einkalífs svo lengi sem meginreglur og sjónarmið Mannréttindadómstóls Evrópu séu virt. Dómstólar aðildarríkjanna hafa meira svigrúm varðandi ákveðin sjónarmið og má þar helst nefna flokkun ummæla í gildisdóma og fullyrðingar um staðreyndir. Mannréttindadómstóllinn gefur sér þó alltaf fullnaðarúrskurðarvald varðandi það hvort skýr og sannfærandi rök mæli fyrir um að dómstóllinn endurskoði mat aðildarríkjanna.

  • The main subject of this thesis is to examine whether the Supreme Court and other Icelandic Courts adhere to the methodology of The European Court of Human Rights when addressing cases regarding freedom of expression whilst still examining the scope of the margin of appreciation granted to the member states when balancing Right to Private Life and Freedom of Expression. To examine this, the landmark cases of the European Court of Human Rights regarding the overlap of Freedom of Expression and Right to Private Life, were reviewed and compared to the decision of the Icelandic Courts. In order to fully do this examination justice, it was necessary to review the methodology adopted by the European Court of Human Rights in resolving such cases and what rules of interpretation apply to the Treaty. In this context Cases of the European Court of Human Rights, regarding Freedom of Expression and its overlap with Right to Private Life, against Iceland were examined. It was also examined whether those cases changed the Supreme Court´s methodology especially after the period of 2012 when Iceland lost a number of cases before the European Court of Human Rights. The conclusion is that in the beginning Iceland did no fulfill the requirements made by the European Convention of Human Rights by failing to adhere to the methodology set by the European Court of Human Rights regarding the balancing act of Freedom of Expression and the Right to Private Life. Following this repeated litigation against Iceland regarding infringement of Freedom of Expression the Supreme Court’s approach changed drastically and now largely resembles the resolutions of the European Court of Human Rights in similar cases. Thus, today, the Supreme Court largely adheres to the methodology proposed by the European Court of Human Rights in cases regarding Freedom of Expression. Furthermore, the Member States are generally allowed a certain margin of appreciation in their assessment as long as the main principles and criteria of the European Court of Human Rights are respected. The Courts of the Member States are allowed greater margin of appreciation in certain circumstances regarding certain assessments. One of those is the categorization of comments into either Value Judgements or Factual Statements. The European Court of Human Rights always reserves the finality of the assessment to its self. Regarding the assessment the European Court of Human Rights needs cogent reasons to revisit the assessment of the Member States.
