Skipan dómara við Landsrétt : greining á þeim athugasemdum sem settar hafa verið fram

Abstract

Markmið ritgerðarinnar er að skýra fyrir lesanda þær réttarreglur sem eiga við um skipun dómara á Íslandi með sérstöku tilliti til nýs millidómstigs, Landsréttar. Fjallað verður um það hvað það er sem felst í þrískiptingu ríkisvaldsins og þeim hugmyndum settar hafa verið fram um réttarríkið.Farið verður yfir það hvernig skipun dómara á Íslandi hefur verið háttað og hvað það var sem varð til þess að skipun við hið nýja millidómstig, Landsrétt, fór fyrir dómstóla á Íslandi ásamt Mannréttindadómstóls Evrópu. Í lokin verða greind þau álitamál sem upp komu í kjölfar niðurstöðu dómanna.

The aim of the dissertation is to explain to the reader the legal rules that apply to the appointment of judges in Iceland, with special regard to Icelandic Court of Appeals.It will be explained what constitutes a threefold division of state power, together with ideas about the rule of law, and how both are to promote legal security and trust in a democratic society. The emergence of a new intermediate court, the National Court, which began work in 2018. It will be explained how the order was handled and what led to the order going to court in Iceland as well as going to the European Court of Human Rights. The issues that arose following the verdicts and how they are likely to affect the Icelandic legal system and the public's trust in that context are analyzed.
