This thesis provides a comprehensive analysis on exploring the Carbon Border Adjustment Mechanism against the backdrop of International Climate Law and EU Climate Law Regime. The European Union’s Carbon Border Adjustment Mechanism represents a vital development in climate policy, aiming to prevent carbon leakage and promote global emission reductions by imposing a carbon price on imported goods equivalent to the EU Emission Trading Scheme (EU ETS). This thesis critically examines the internal dynamics of the EU climate legislation, stipulating some of the international influences and examining the CBAM within a broader framework of international climate law, especially the Kyoto Protocol and the Paris Agreement. As an EU policy aimed at combatting carbon leakage, the thesis will also outline CBAM compatibility with the EU climate regime, particularly the EU ETS and the European Climate Law. The CBAM policy in coherence with these EU climate law regime , ensures that the climate targets goals are attained, while upholding international trade rules.
While the CBAM is effective in mitigating carbon leakage, the policy still ensures that the EU is capable of combatting future unforeseen carbon leakage problems. However, the policy is still subjected to some shortcomings in its implementation
