  • Megintilgangur ritgerðarinnar er að skoða áhrif þeirrar alþjóðasamvinnu sem íslenska ríkið tekur þátt í á fullveldið og afstöðu til fullveldis á Íslandi. Leitast er við að svara spurningum um hvað felist í fullveldi, hver séu tengsl þess við framsal ríkisvalds og hvaða áhrif þeir samningar sem íslenska ríkið hefur gert hafa á fullveldi Íslands.
    Í því sjónarmiði verða helstu þjóðréttarsamningar sem íslenska ríkið hefur gert skoðaðir, það greint hvort ríkið hafi framselt hluta valdheimilda sinna á grundvelli þessara samninga og lagt mat á hvort slíkt framsal hafi áhrif á fullveldið.
    Síðan íslenska ríkið varð fullvalda þann 1. desember 1918 hafa Íslendingar tekið þátt í viðamiklu alþjóðasamstarfi sem vakið hafa upp spurningar um fullveldi og mögulegt framsal valdheimilda ríkisins til alþjóðastofnana. Þær þjóðréttarlegu skuldbindingar sem íslenska ríkið hefur tekið á sig með aðild að alþjóðastofnunum eða samningum og skoðaðir verða í þessari ritgerð eru aðild að Sameinuðu þjóðunum, ýmsir mannréttindasamningar, aðild að Norður-Atlantshafsbandalaginu, varnarsamningur við Bandaríkin og samningurinn um evrópska efnahagssvæðið. Helstu niðurstöður ritgerðarinnar eru í fyrsta lagi þær að afstaðan á Íslandi breytist með EES-samningnum. Fram til ársins 1990 var framsal hluta valdheimilda talið vera beiting á fullveldinu en einhverra hluta vegna breyttist það eftir að EES-samningurinn tók gildi. Í öðru lagi er niðurstaðan sú að íslenska ríkið hafi vissulega framselt hluta valdheimilda sinna til alþjóðastofnana, en það hafi ekki áhrif á fullveldið. Í skilgreiningum fræðimanna á fullveldishugtakinu telst ríki vera fullvalda ef það fer með æðstu stjórn á yfirráðasvæði sínu nema að því marki sem leiðir af reglum þjóðaréttar. Í fullveldinu felst rétturinn til þess að taka þátt í alþjóðasamstarfi og deila valdheimildum ríkisins með öðrum ríkjum eða alþjóðastofnunum, svo lengi sem það er gert á grundvelli stjórnlaga ríkisins og að ríkið stofni til þessara samninga af fúsum og frjálsum vilja.

    The aim of this thesis is to examine the impact on international cooperation on Iceland’s sovereignty, and review the stance in sovereignty in Iceland. Attempts are made to answer questions about the meaning of sovereignty, its connection to the transfer of state power
    and the effect on the sovereignty of Iceland.
    In this regard, the most extensive international agreements concluded by the Icelandic state are reviewed, determined whether the state has transferred part of its powers on the basis of these agreements, and assessed whether such extradition affects the sovereignty.
    Since Iceland became sovereign on 1 December 1918, the state has participated in extensive international cooperation that has raised questions about sovereignty and possible assignment of state powers to international organizations. The main international obligations entered into by the Icelandic state through membership of international
    organizations or agreements, which will be considered in this thesis, are membership of the United Nations, various human rights agreements, membership of the North Atlantic Treaty, defense agreement with the United States and the European Economic Area Agreement.
    The main conclusions of the thesis are that the Icelandic state has surrendered some of its powers to international organizations, but it does not affect the sovereignty. In the definition of sovereignty, states are considered sovereign if they are in command of their
    territory, except to the extent required by international law. The sovereignty includes the right to participate in international cooperation and to share the powers of the state with other states or international organizations, as long as it is done on the basis of the
    constitutional law of the State and that the state establishes these agreement voluntarily.
