    Þegar erlendir ríkisborgarar eru framseldir eða vísað úr landi rísa oft álitamál um hvort brotið sé gegn ákvæðum Mannréttindasáttmála Evrópu (MSE). Mannréttindómstóll Evrópu hefur í all mörgum málum talið að brottvísun eða framsal einstaklings feli í sér brot á sáttmálanum. Þau ákvæði sáttmálans sem koma hér til álita eru einkum 2. gr. (rétturinn til lífs) og 3. gr. (bann við pyndingum og ómannlegri meðferð eða refsingu). Í nokkrum tilvikum hefur verið talið að 8. gr. (friðhelgi einkalífs og fjölskyldu) hafi verið brotin.
    Í þessum dómum hefur verið talið að aðstæður sem einstaklingum bjóðast eða meðferð sem þeir kunna að sæta í því landi sem þeim er vísað til feli í sér brot á fyrrnefndum ákvæðum. Þegar útlendingar standa frammi fyrir brottvísun eða framsali er algengt að þeir sendi beiðni til dómstólsins um beitingu bráðabrigðaráðstafana samkvæmt 39. gr. málsmeðferðarreglna dómstólsins, þannig að ríki verði meinað að vísa þeim úr landi meðan mál þeirra er til meðferðar fyrir dómstólnum. Lengst af var talið að samningsríkjum bæri ekki skylda til að fara að tilmælum dómstólsins. Dómstóllinn hefur á hinn bóginn á síðari árum talið að vanræksla samningsríkja í þessu efni feli í sér brot á 34. gr. MSE (kærur einstaklinga)
    Í þessari ritgerð er gerð gein fyrir reglu 39, sem svo er nefnd, og framkvæmd hennar. Þá er rakin dómaframkvæmd dómstólsins þar sem reynt hefur á ákvæði 2., 3. og 8. gr. sáttmálans í brottvísunar og framsalsmálum og þess freistað að draga saman meginatriðin í henni.
    Að lokum er gerð grein fyrir réttarframkvæmd á Íslandi og metið hvort framkvæmd hér á landi er í samræmi við kröfur sáttmálans. Niðurstaðan er í meginatriðum sú að framkvæmdin á Íslandi sé í góðu samræmi við sáttmálann.

  • Deportation and extradition of foreign nationals may often give rise to breaches of provisions of the European Convention of Human Rights (the Convention). In such cases The European Court of Human Rights (the Court) has often found a violation of the Convention. The articles in question are mainly Article 2 (the right to life) and Article 3 (prohibition against torture and inhuman or degrading treatment or punishment). In exceptional cases a violation of Article 8 (respect to private and family life) has been considered.
    In these cases the Court has concluded that the conditions or the treatment that the applicant will have to endure in the receiving state will entail a violation of the aforementioned articles. It is common practice that foreign nationals request the Court to indicate an interim measure, from article 39 of the Rules of the Court, to the contracting party, in order for a stay of execution of the deportation or extradition whilst the Court is processing their application. Until recently the contracting parties were not considered legally bound to comply with an interim measure. However, the Court has in recent years ruled that failure to do so can lead to a violation of Article 34 (the right of individual application).
    This thesis will explain the conditions and procedure of Rule 39. The case law in deportation and extradition cases concerning articles 2, 3, and 8 of the Convention will be examined and an attempt will be made to outline the essence of the Court’s jurisprudence in this field.
    Finally the procedure in Icelandic cases regarding the aforementioned category will be analyzed in order to compare it with the procedural standard that the Court has developed. The overall conclusion is that the practice in Iceland is in general, in accordance with convention standards.
