    Markmið þessarar ritgerðar er að varpa ljósi á íslenska réttarframkvæmd hvað varðar samningu dóma. Byrjað er á því í fyrri hluta ritgerðarinnar að fara yfir hvaða þýðingu dómar hafi í réttarskipaninni, enda er mikilvægt að átta sig á henni til þess að gera sér grein fyrir mikilvægi þess að dómar séu vel samdir. Einnig er farið yfir þróun samningu dóma á Íslandi, bæði hvað varðar einkamál og sakamál, og mismunandi tegundir dómsúrlausna. Þá er farið yfir mikilvægi sératkvæða og greint frá rannsókn á fjölda þeirra undanfarin ár.
    Í síðari hluta ritgerðarinnar koma fram nokkrar hugleiðingar höfundar um áhrif samningu dóma á fordæmisgildi dóma, og þar nefnd til sögunnar nokkur tilvik sem skipt geta máli hvað það varðar. Loks er farið yfir frumvarp sem liggur fyrir á Alþingi um breytingar á ákvæði laga um meðferð einkamála nr. 91/1991 um samningu dóma. Er þar greint frá því í hverju breytingin felst svo og umsögnum hæstaréttardómara um breytingarnar, en þar er að gæta mismunandi sjónarmiða meðal dómara Hæstaréttar.
    Aðallega er stuðst við fræðibækur og fræðigreinar sem birtar hafa verið í viðurkenndum ritum um lögfræði. Þá er stuðst við hin ýmsu lög sem koma að samningu dóma að einhverju leyti.
    Helstu niðurstöður ritgerðarinnar eru á þá leið að unnt sé að bæta löggjöf um samningu dóma að mörgu leyti og helst á þá leið að fram komi hvaða dómari hafi samið tiltekinn dóm og að aðrir dómarar skrifi undir þá niðurstöðu með nafni séu þeir sammála henni, en annars skili þeir séráliti.

  • The purpose of this thesis is to shed light on Icelandic court precedents regarding the writing of judgments. In the first part of the essay, the meaning of judgments for law and order is discussed, since it is important to understand that, in order to realise the importance of well written judgments. The thesis also provides an overview of the writing of judgments in Iceland, in civil as well as criminal cases, and the different types of judgments. Additionally, the importance of dissents is discussed, and the results of a study on the amount of dissents over the last years are revealed.
    In the second part of the thesis, the author reveals his thoughts on the effect of the writing of judgments on their precedence value, and mentions in that context a few incidents that may apply in that regard. Finally, a parliamentary bill that has been submitted to Althingi on changes to the provisions of the Act on Civil Procedure No. 91/1991 that stipulate on the writing of judgments is discussed. In that regard, the implications of the changes are revealed as well as the opinions of Supreme Court judges on the proposed changes. It is noted that the Supreme Court judges disagree on the matter.
    Mainly, scholarly books and works, which have been published in recognized journals on law, are cited. In addition, the various laws that discuss the writing of judgments are utilised.
    According to the main results of the thesis, it is possible to improve the provisions on the writing of judgments in many ways, most importantly in the way that it is disclosed which judge wrote the particular judgment and that other judges should sign that judgment with their names if they agree, and if the do not, dissent.
